Ma’aser From A Wife’s Money

Question:

My wife worked for two years before she was married. She gave ma’aser regularly. Now that she is married and I receive the money, do I need to give ma’aser again?

Answer:

No. This question was posed by the Ya’avetz in his reponsa (no 6). He claims that you don’t have to since you are only receiving the money as a loan and need to return it in the event of your divorce or demise. However if your wife predeceases you, you will then need to give ma’aser just like anyone who inherits money needs to give ma’aser from the assets that he inherits.
