Nosy Neighbor

Question:

Is it forbidden to look into someone else’s garden just as it is forbidden to look into someone’s house?

Answer:

It is forbidden to look into another Jew’s yard and watch the people there (Ramo, C.M. 154:3, 154:7). If your Jewish neighbor will minimize his activities as a result, it is as if you were depriving him of the use of his property, which is comparable to damaging or stealing his property. Even if he is not going to change his behavior, it is inappropriate since he may not want you to know what he is doing (Graz, Nizkei Mammon 11).

The Sema (154:14) understands the Ramo to forbid looking out your window at something other than your neighbor’s yard if your neighbor will suspect you of looking at his yard.

However, if you are walking in the street or looking out your window and happen to see something in your neighbors’ yard, you have not done anything wrong. What is forbidden is looking deliberately or standing in a place that makes it look as if you were snooping. (( עיין רמ”א חו”מ סימן קנ”ד ס”ז וז”ל אסור לעמוד בחלון ולראות בחצר חבירו כדי שלא יזיקנו בראייתו ובזה איסורא קא עביד עכ”ל. ובשו”ע הרב הל’ נזקי ממון הי”א פירש שאסור להסתכל בחבירו בענין שיש לחוש שיזיקנו בעין רעה ופירש מש”כ הרמ”א שם בס”ג וז”ל י”א שצריך ליזהר אדם מלהסתכל בבית חבירו עד שהוא נתפס כגנב בראייה ההיא עכ”ל דמיירי באופן שאין צריך לחוש להיזק עין רעה ומ”מ צריך ליזהר להסתכל לראות מה שחבירו עושה בביתו שלא מדעתו כי שמא אינו חפץ שידעו ממעשיו ומעסקיו. ובסמ”ע קנ”ד ס”ק י”ד פירש ב’ דברי הרמ”א בהסתכלות בעניני חבירו אף שאין שייך עין הרע ובס”ז כתב האיסור ובס”ג כתב שאף לא יעמוד במקום שנראה לאחרים כאילו עומד בכדי להסתכל אף אם לפי האמת אינו מסתכל, מ”מ צריך ליזהר כדי שלא יהא נחשד בעיני הבריות. וע”ז הוא דמוסיף בשו”ע הרב משכ”ל דאי”ז אלא בשכן אבל בני רה”ר שרואים ראייה קלה דרך הילוכם שרי. ))
