Suing the Rabanut for Moral Damage

Dear Rabbi I have been denied my condition of Jew in the last 5 years by the Rabanut of Argentina. They have not been any helpful to clarify (to themselves) my ‘Jewishness’.

Now I have the documents to prove it. Can I sue the Rabanut for moral damage?

They knew I was a Jew all along but they did not want to help me.

Answer:

It is difficult to believe that they know all along that you were Jewish, yet did not wish to help you. Why would they wish to act with such malice? I hope and believe that they only wished to ensure that you were, indeed, Jewish, because this is a very serious matter, and that now that you are able to prove it, they will gladly accept you into the community.

Suing for moral damage is not accepted according to Torah law, and one can only sue for actual, concrete damage. Perhaps you can ask them for different forms of assistance that you need, and that they would now be willing to provide.
