Ribbis of Paying Back Past Loan

Someone borrowed money from a friend in the amount of $1000. Much time went by and he never paid it back. The one who lent the money you could say was “misyi’ash” and thought he’d never get the loan back (however he was not mochel the person.) The original borrower came around again asking his friend for another loan. His friend said he would only give it on condition he begin to pay back the previous loan. Is there any problem of ribis here?

Answer:

There is no problem of ribbis here. The borrower is not giving anything beyond that which he owes, and the creditor is not receiving anythign worth money beyond that which he is owed.

The time for a loan, where no time is given, is thirty days, and if the loan is beyond thirty days, so that the borrower is obligated to pay, and if the chance of another loan is used to persuade him to fulfill his obligation, this is fine.
