Arbitration Clause

Can you please give me a nusach that we can use in an employment contract to stipulate that disputes should go before a beis din, even though the contract will be governed by state law? It should also include details on how a beis din will be chosen should the need arise.

Answer:

You basically need to put in an arbitration clause. It can go something as follows:

“Any dispute or difference arising out of or in connection with this contract shall be determined by a beis din (tribunal of Torah Law), whose identity is to be agreed between the parties. Failing agreement within fourteen days, each party will appoint one dayan of the beis din, and the two appointed dayanim will agree upon a third to form a “zabla” arrangement.”
