Mekach Ta’us for Rail

I bought a guard rail for a bed. it was 2 feet long i asked the store owner “is this the longest it comes” – he said yes. I paid him with a credit card. I then found out that there are longer ones, just the store did not have it. I returned it to the store to get my money back. The seller told me the store policy is only exchange but no refund of money. There was no sign in the store saying that. I left the rail in the store and left. I then called the credit card co. and disputed the charges. Was it a mekach ta’us? Does the store owner have to refund my money? Did i have a right to tell my credit card company i am disputing the charge?

If you bought the rain under the assumption that this is the longer rail available (meaning, the longest that is made), and it turns out this assumption was false and that the store owner gave you a false impression, the purchase is a mekach ta’us and you are within your rights to return the rail to the store and receive your money back. The refund policy of the store doesn’t make a difference.

If this requires disputing the credit card charge, this is also fine.

However, perhaps it is possible to ask the store to order the longer rail for you, and use their refund policy in this way.
