Knowing the Laws of Gittin

A mesader gittin that didn’t know the Din that they may not live in same Shechuna, is he allowed to proceed with the get?

Answer:

The question cannot be answered without further investigation.

Every rabbi/dayan can forget a halachah, in particular the halachah mentioned in the question, which does not usually reach a practical level today (our ‘neighborhoods’ are different from the ‘shechunah’ of Chazal).

Therefore, the relevant Beis Din should ensure that the person in question is well acquainted with the intricacies of the laws of Gittin, and if he knows them there’s no problem with him continuing to arrange the Get.

Best wishes.

    1. It is best to write by email. Best wishes.

  1. I am sitting on a Beis Din soon, as requested by the husband. Am I expceted to do anything other than witness the giving of the get to the wife or her agent?

    1. I don’t know the situation, but if the get is being given by a reputable bais din, you can ask the mesader of the get, what is expected of you.
