Short Veses (Period) Uprooting Long

In Yoreh De’ah (189:13) there is machlokos between the Shach and Taz whether a shorter period (veses) can uproot a longer one. Who do we pasken like and why?

Answer:

One can be lenient in this matter.

Best wishes.

Sources:

Many authorities side with the Shach (who is lenient, i.e. the short veses uproots the longer one), including the Bach, Sidrei Taharah, Kereisi U-Pleisi, Darkehi Taharah, Chayei Adam, and others.

However, other authorities, including the Beis Meir and the Shulchan Aruch Ha-Rav, side with the Taz who is stringent.

The custom in this matter is to be lenient, as the ruling of the Shach. This is attested to by the Cheshev Ha-Efod (Vol. 1, no. 126, sec. 3). Moreover, to be careful for the longer period will lead to complex calculations that not everybody can handle. Moreover, it is possible that a woman will have to recall an unusually lengthy veses for years, which we certainly don’t see.

The Shevet Ha-Levi rules that one should rule leniently for people in the first year of marriage (Shiurei Shevet Ha-Levi 189:14). For most people, with the exceptions of whose who wish to accept stringencies upon themselves, this period can be extended to later years, too. [The Shevet Ha-Levi is also lenient after three shorter periods.]
