Tailor Damages

I am a middleman between a dry cleaners and a yeshiva. a bochur sent in a jacket for cleaning. When he got it back he claimed that the cleaners “opened” up the inner lower seem of the jacket. He had to pin it with a safety pin to wear for shabbos. He dose not want to pay for the dry cleaning of the jacket. He subsequent paid a tailor to fix the seem.
The dry cleaners refuses to take responsibility. They said that even on the off chance taht they caused the “damage” they are not responsible to pay as per the disclaimer on the receipts.
the cost of the tailor exceeded the cost of cleaning.
Thank you

Answer:

If in fact upon giving in the clothes he was given a receipt which dictates that the cleaners are absolved of all damage to the clothing, they would not be responsible. Generally the cleaners put a limit on their responsibility, but don’t absolve themselves entirely. If that is the case the bochur may with hold payment to pay for the repair to the jacket.
