Answer:
What you are referring to is the heter of “apei tloso”, if lashon hora is publicised that it may be said over. The Chofetz Chaim (Hil. Lashon Hora says 2-3 and 7-6) says that if the person had intention to spread the bad information that it is still lashon hora and not permitted. The reason is because there are two negative parts to speaking lashon hora, the damage that is being done to the person spoken about, and the negative effect it has on the speaker of the lashon hora, that he is involving himself is speaking harmfully about other people.
