Question:

My friends were in a store at the Malcha mall in Jerusalem and the clerk in a certain store told them that a customer left two brand new books in their store and they weren’t able to return them to this anonymous customer since they didn’t know who it was. They put up a sign for 4 months and no one came to claim it. They asked this couple if they would take the books since they have no use for them. My friend gave me one of the books since she already owns it. It is a frum book that is brand new! Am I obligated to do something about it? What do you think? I wasn’t sure if I should keep it or try to do something else. I mean, I’m not even sure if they really did put up a sign in the store or if all the information is in fact correct.

Answer:

You can keep the brand-new book. The information you received can be assumed as accurate. I cannot think of any plausible motive for the store owners to fabricate such a story and give away the books other than the truth. Your friends may conceivably have an ulterior motive to give this book to you and may have fabricated the story, but even if this were true, the books are a gift and yours.

An item left in a store needs to be held onto until the owner comes to collect his item. ((If the item had an identifying mark, for example, if the book had a name and number in it, the store should call the owner and notify him so that he can retrieve his book. It is the responsibility of the one who lost the item to collect the item. The finder is only responsible to notify the owner; he does not need to bring it to him. The finder can specify a reasonable amount of time for the owner to collect his item. When that time has passed the finder may keep the item for himself. Since the owner knew where his item was and neglected to pick it up within a reasonable period it is as if he has willingly forfeited it. It becomes an aveidoh mida’as and ishefker. )) It is the halachic equivalent of an item found in a manner which indicates that the owner purposely left it there (derech hinuach). ((בסימן ר”ס ס”א מבואר דאע”פ דהמוצא חפץ בדרך הינוח (שניכר שהונח שם בכוונה ולא נפל), והוא במקום המשתמר, אין ליגע בו בין שיש בו סימן בין שאין בו סימן. מ”מ אם ניכר שמונח שם ימים רבים ודאי כבר נתייאשו הבעלים והרי הוא של המוצאו אף אם יש בו סימן (ערס”ב ס”ה). בד”א כשבא לזכות בו לאחר שכבר נתייאשו הבעלים, אבל אם זכה בו קודם יאוש בדבר שיש בו סימן צריך להכריז ובדבר שאין בו סימן נעשה כשומר עליו ואינו יכול לזכות בו לעצמו. ובהקדמה זו תבין מש”כ למעלה. דהרי נד”ד י”א דהוי כבא לידו לאחר יאוש וא”כ זכה בו בעל החנות ויכול לעשות בו מה שירצה וי”א דזכה בו בעל החנות קודם יאוש וכיון שאין בו סימן נעשה כשומר עליו(עיין ציון 3), אבל כיון שנותנו לאחר שרי לשני להחזיקו לעצמו דבהיתירא אתי לידיה דכבר נתייאשו הבעלים, ואם יבא הבעלים שהשאירו החפץ יתבעו מבעל החנות אם יש להם עדים שהיה שלהם )) If a significant amount of time has elapsed so that it is obvious that the owner forgot where his item is we can assume that the owner has given up hope of ever retrieving his item. ((עיין סימן ר”ס ס”א. ולשון הרא”ש שבודאי שכחו הבעלים היכן הניחו ונתייאש. ונראה אם שכח לגמרי מהחפץ אי”ז יאוש. )) Therefore, some authorities allow the store owner to keep the item and do whatever he wants with it.

Other opinions do not allow the owner to keep it for himself. ((מקצת פוסקים ס”ל דיכול בעל החנות להחזיק החפץ שאין בו סימנים לעצמו דחשיב כאילו זכה בו לאחר יאוש ובהיתירא אתי לידיה ומקצת פוסקים ס”ל דאינו יכול להחזיק לעצמו כיון דס”ל דבאיסורא אתי לידיה ואסור לו להחזיקו, ואבאר.
בב”מ כו. מבואר דאין יאוש מועיל אלא כשבא האבידה ליד המוצא לאחר יאוש, אבל כשבא לידו קודם יאוש, אע”פ שאח”כ התייאש הבעלים כבר נתחייב בהשבה ואין היאוש מועיל לפוטרו. המוצא חפץ שאין בו סימן מניחין שמיד לכשיוודע לבעלים שנפל ממנו בודאי מתייאש, ולכן בדרך כלל המוצא מציאה שאין בה סימן הוי כבא לידו לאחר יאוש דיש לתלות שכבר נודע לו שנפל ממנו וכבר נתייאש. אמנם אם בא לידו קודם שנודע לבעלים שנאבד ממנו כבר נתחייב בהשבה ואין היאוש פוטרו וע”ז אמרו יאוש שלא מדעת לא הוי יאוש (חו”מ רס”ב ס”ג). וטעם הדבר מפרש הגמרא דבאיסורא אתי לידיה ובקצוה”ח רנ”ט סק”א ביאר דאין הכוונה שעשה איסור בהכנסת החפץ לרשותו אלא ר”ל בשעת איסור כלומר בשעה שחייב בהשבה.
והנה בש”ך רס”ח סק”ב הביא מש”כ בחכמת שלמה (כו. על תוד”ה דשתיך) דאם בא חפץ לחצרו לפני יאוש לא שייך לומר דבאיסורא אתי לידיה, ואם היה יאוש אח”כ מהני דיהיה של בעל החצר דיכול לזכות בו אח”כ. אמנם הש”ך העלה להלכה כדעת הרא”ש ונמק”י שגם בבא החפץ לחצרו מיקרי באיסורא אתי לידיה וחלק על המהרש”ל וס”ל דאף תוס’ ס”ל הכי, וכ”כ ברס”ב סק”א.
אמנם בנתיה”מ רס”ב סק”א כתב שלא אמרו דכשבא לחצירו קודם יאוש דלא קנה אלא כשבא לזכות מחמת החצר כגון שבא אחר וטען שהוא שלו ובא בעל החצר וטוען כנגדו שהוא זכה בחפץ קודם ע”י חצירו. אבל כשאומר לא ניחא לי בקנין ובשליחות החצר ורצוני לקנות בהגבהה דוקא ודאי אין חצירו קונה לו, דלא עדיף מזיכה ע”י אחר וצווח כששמע דאינו זוכה דאין אחר יכול לזכות עבורו בע”כ (ע”ע נתיה”מ סימן ר”ס סק”ט).
ועוד, בחידושי רע”א בהשמטות לב”מ הקשה איך יזכה חצירו לו כיון שאין זה זכות עבורו לקנותו קודם יאוש ותירץ דמשום חובת ומצות השבת אבידה נעשית חצירו כידו בע”כ, וממילא ס”ל דבאבידה שאין בה סימן שיודע שלא יוכל להשיבה שאין בה חיוב נטילה (כ”ד רע”א בדרו”ח כא: ד”ה אמנם, ושמעתי דכן הכריעו הגרי”ש אלישיב והגר”נ קרליץ שליט”א, אבל בשו”ע הרב הלכות מציאה ס”ב כתב שאף בדבר שאין בו סימן כל שלא נתייאשו הבעלים צריך ליטלו על דעת להחזיר למי שיתברר עפ”י עדים שהוא בעליו, וכ”ד התהלה לדוד ואג”מ חו”מ ח”א סימן מ”ה), אה”נ שלא זכתה לו חצירו ולא מיקרי באיסורא אתי לידיה.
נמצא דלמהרש”ל, נתיה”מ ורע”א בנד”ד לא יזכה בעל החנות בחצירו קודם יאוש (דלא גילה דעתו שרוצה לזכות דוקא בחצר ועוד דהוי דבר שאין בו סימן), ואח”כ כעבור כמה חדשים שודאי נתייאש יוכל בעל החנות לזכות בו לעצמו. אמנם לדעת הש”ך נראה דזכה בעל החנות בקנין חצר ושפיר נתחייב בהשבה קודם יאוש ואינו יכול לזכות בו לעצמו.
אמנם נראה דגם לש”ך איכא עצה שיכול בעל החנות להתנות שאינו רוצה לזכות בחפצים המושארים בחצירו דאז ודאי לא יזכה בהם קודם יאוש, ולאחר שיחכה זמן רב שבודאי נתייאשו הבעלים יוכל לזכות בהם. )) They make the following distinction: if there is an identifying marker on the item, the store owner is required to announce that he found the item and is prepared to return it to the rightful owner. If there is no identifying marker on the item they must hold the item indefinitely. ((כ”כ בגר”ז הלכות מציאה ס”ב דביאוש שלא מדעת יהא מונח עד שיבא אליהו, והוא דעת הראב”ד, הרמב”ן, והרשב”א וכן סתם השו”ע ברס”ב ס”ג. אמנם איכא דעת הסמ”ע לפרש שיטת הרמב”ם שאם הגביה קודם יאוש ע”ד להחזיר ונודע לו שאין בו סימן, מותר לו לזכות בו לאחר יאוש (עיין סמ”ע סימן ר”ס ס”ק מ”ב וברע”א שם ובדרישה ס”ס ר”ס וע”ע פט”ו מגזילה ואבידה במ”מ ובכ”מ שם ובב”’י ס”ס ר”ס, ובש”ך ר”ס ס”ק כ”ו כתב ביישוב שיטת הרמב”ם דאע”פ דלא זכה בו מ”מ שרי ליה להשתמש בו כל זמן שלא יתברר של מי הוא, ולכשיתברר ע”י עדים יחזירנו לו). וכבר כתב באג”מ חו”מ סימן מ”ה עצה למי שמחזיק בחפץ שדינו יהא מונח עד שיבא אליהו, דיכול לשום החפץ ולרשום הפרטים במקום משומר (ושמעתי עצה טובה לרשום מציאות בדף ראשון של הש”ס), ואז יכול להשתמש ואם יבא עדים או בעל החפץ אם סימנים ישמו להם שוויו. )) If the store owner gave the item away to someone else (after it is clear that the original owner will not return for his item), all opinions agree that the recipient is allowed to keep the item which does not have any identifying markers on it. ((כיון דבהיתירא אתי לידיה נראה דשרי ליה להחזיקו. דהא לאחר יאוש ליכא איסור לא תגזול וחיוב השבה חלה על בעל החנות. ועיין בדברי משפט סימן ר”ס סק”ב דלדעת החולקים על הרמב”ם (דקי”ל כוותיהו כמשכ”ל בהערה הקודמת) שאסור לבעל החנות להשתמש בחפץ כיון דבאיסורא אתי לידיה אם בא אחר וחטף מיד המוצא זכה החוטף בחפץ כיון שהמוצא אסור להשתמש בו וגם מצות השבה אין כאן כיון שכבר נתייאשו הבעלים ואין יודע מי הוא, ונראה דאם המוצא מוסרו לאחר לא גרע. וסיים שם דאפשר שאף לכתחילה מותר לחטוף מיד המוצא.

If, however, the owner of the store were to make it clear that he does not want his property to acquire (kinyan chotzer) any items that people might leave in his shop, all opinions would agree that after a significant amount of time has elapsed, he may keep the items and do whatever he wants with them. Such an expression of intent should be done before any items are brought in to his property. Once this is done, the item left behind belongs to the one who left it and the store owner does not have an obligation to return it to the owner. When enough time elapses and it is clear that the owner has forgotten where the item is, the store owner can claim it as his own just as any other item that was found after being abandoned (yiush). If this technique was used, the store owner would be allowed to even keep items that have identifying characteristics. However, one should only plan to use this technique for items that do not have simanim. Because a person who sees an item that hassimanim and can return it to the rightful owner, must do so. If he did not return the item with simanim as he should have done and did not pick it up or make a differentkinyan on it, should the store owner take that item for himself after the owner gave up hope on retrieving it, the item will belong to him.

The brand-new book probably does not have any simanim (identifying markers) on it and since four months went by without any claims on the books, it can be assumed that the original owners have given up hope of ever retrieving their items. Therefore, according to some opinions the store owners can keep the book, but according to all opinions you surely can keep the book.

In privately owned areas in which many people pass through and forget items there, such as mikvaos, buses, schools, stores or hotel rooms one can post a sign stating that after a specific amount of time all items left will become the property of the owner of the area. This is also true for a shoemaker or dry-cleaning store that may have items left on their premises that are not claimed. Care should be taken to place the notice conspicuously so that everyone entering the premises sees it. If this is done, all opinions would agree that even the owner may keep the forgotten item when the specified time has elapsed.
