Shabbos – Chazara – Returning Food to Heat on Shabbos

Introduction

According to the Torah, food may be removed directly from the fridge and heated up on Shabbos as long as the food is fully cooked and dry so there is no problem of bishul – cooking. However, Chazal made a fence that one should not return food, even to the same source of heat that it was on initially ((מקור הוא במשנה שבת לו:.עי’ ס’ שבות יצחק פרק יט שמסביר אם החשש שמיחזי כבישול כלפי עצמו או כלפי אחרים. וע”ע ברשב”א שם בענין מה הגדר של דרך בישול בזה וז”ל “שאין דרכם של בני אדם לבשל כן רוב פעמים, אינו נראה כמבשל אלא כמפיג צינה)). A food or liquid that is fully cooked, even if it is still hot, may not be returned to its source of heat on Shabbos, unless the conditions listed below are fulfilled. This prohibition is called חזרה.

The ראשונים give two reasons as to why this is prohibited on Shabbos:

  • מיחזי כמבשל – placing food onto a source of heat (even if it was there initially) looks like an act of cooking ((כ”כ רש”י לו:, רשב”א (שבת מ:) ור”ן (שם) וטעם של ראשונים אלו שלא חוששים לשמא יחתה עי’ ס’ שבות יצחק עמ’ רט שכתב דלא חששו שמא יחתה רק במשהה קדירה דלא בשיל דאז בהול על תבשילו שמא לא יהיה מוכן לאכילה וחששו שמא יחתה, אך בתבשיל מבושל כ”צ אין לחוש שמא יחתה)) .
  • שמא יחתה – when re-placing food onto a source of heat, there is a concern that one may first stoke the flame so that the food should become hotter ((תוס’ שבת לח: ד”ה פינה, ספר הישר לר”ת סי’ רלז הובא בשעה”צ סי’ רנג ס”ק לז. וכ”כ המג”א ס”ק כו, לג ומב. וכ”ה בחזו”א. ועי’ באור שמח ריש פ”ג הל’ שבת שתלה ב’ טעמים אלו במחלוקת אי איכא איסור בישול לאחר שנתבשלה הקדירה כמב”ד ע”ש. וע”ע בחזו”א סי’ לז ס”ק כא ד”ה ונראה, ובה”ל סי’ רנג ס”ה שלכאורה יש מח’ מהו הגדר של איסור חזרה, אם הוא מעשה הנתינה על האש שאסורה (וכן לומד הבה”ל שם), או שמא האיסור הוא עצם מציאות הקדירה על האש ואז חוששין שמא יחתה (כן לומד החזו”א) וע”ע לקמן בסוף הלכות חזרה שיש נפק”מ להלכה בזה לענין חזרה ע”י גוי)) .

Nevertheless, if certain conditions are fulfilled (as will be explained below – page 43), Chazal allowed chazara – returning food to the source of heat – on Shabbos, since then it looks as if one is merely continuing the cooking that was started before Shabbos.

נתינה לכתחילה – Placing Food On for the First Time

Q. May one place food on the blech for the first time on Shabbos (if it is fully cooked and dry)?

A. No. Only chazara – returning food – is permitted under certain conditions since it is evident that it is a continuation of the original placement of the food on the flame. However, when one places food on a source of heat for the first time, it looks like a new cooking process (מיחזי כמבשל) which is forbidden on Shabbos ((רשב”א הובא ברמ”א רנג ס”ה ומ”ב שם ס”ק פט)) .

Note: Even if the pot/container of food was on the blech when Shabbos began, but one added food that was not on the fire before Shabbos to the pot that was on the blech, it is still forbidden to return the pot since the added food was never on the blech.

Q. If one forgot to put the kneidelech in the chicken soup, may they be added on Shabbos?

A. There is no problem of bishul – cooking, since they are fully cooked and dry. The pot should first be removed from the blech and they may then be added (provided they do not have frost on them from the freezer, which may pose a problem of bishul – cooking when placing them into hot soup).

The pot, however, may no longer be returned to the blech, even though it was on the flame before Shabbos, because it now has inside it food that was not on the blech before Shabbos (even if all of the other conditions of chazara were met – see below – page 43).

Q. If one forgot to put the eggs in the cholent, may they be put in on Shabbos?

A. They may be placed into the cholent after it has been removed from the flame provided they are fully boiled, thus posing no problem of cooking ((ולכמה פוסקים אם הם בקליפה לא יכניס הביצה כולו בתוך הטשולנט משום איסור הטמנה (אא”כ הכוונה הוא שרוצה הטעם של הטשולנט בביצה דבכה”ג אפשר שמותר). ועי’ לקמן בהל’ הטמנה עמ’ 85 .)) . However, the cholent may not be returned to the blech/crock-pot on Shabbos because the eggs were not on the fire when Shabbos began.

Permitted Ways

Although it is forbidden to place food from the fridge directly on the blech [even if there are no bishul problems – e.g., it was fully cooked and dry], there are some permitted ways of re-heating such foods on Shabbos.

  1. On top of another pot.
  2. On a radiator.
  3. Near the flame.

These three methods of re-heating food may be used even if the food was removed from the blech in a manner that it may not be returned (i.e., not all the conditions listed below – page 43 – were fulfilled).

  1. 1. On top of another pot – הפסק קדירה

One may take a cold, dry, fully cooked food and place it for the first time on top of a pot containing food. This is permitted because the prohibition of chazara is only when it appears as if one is cooking, but merely placing food on top of another pot does not give the appearance of cooking ((בה”ל סי’ רנג ס”ג. ומקור לדין זה הוא המרדכי פ’ כירה “מי שהשכים בבוקר וראה שהקדיחה תבשילו וירא שמא יקדיח יותר יכול להסירה ולהניח קדירה ריקנית ע”פ הכירה וכו'” וכ”כ המ”מ פכ”ב ה”ג וב”י סי’ רנג ושו”ע שם)) .  It may be placed directly on the lid of the pot to heat up ((הגר”נ קרליץ שליט”א בחוט שני ח”ב עמ’ קל)) .

  • Therefore, one may warm up a challah or schnitzel directly on the lid of a cholent pot.
  • There is no difference between a gas with a blech on it or a hot plate regarding this halacha. [For more details on hot plates, see page 42.]

Q. May cold food be placed on top of a pot of food that is not on a blech, i.e., it is on an uncovered flame?

A. Yes ((בה”ל סי’ רנג ס”ג. שהקדירה שיש בו תבשיל לא נחשב כלל כעומד על גבי כירה, ולהכי מותר אף לכתחילה. ומקור לדין זה הוא הר”ן בשם הרשב”א שכתב שמותר לתת על פי קדרות חמין תבשיל שמבשל כ”צ. ועי’ בה”ל שכתב שכיון שהקדירה מפסקת ואין זה דרך בישול, עדיפא מכירה גו”ק)) . When doing this, one must be careful of the following two points:

  • The food must be fully cooked and dry so there is no problem of bishul – cooking.
  • A meat pot may not be placed on top of a dairy one (or vice versa). Similarly, a pareve pot should not be placed on top of a meat/milk pot.                                            [See Kashrus in the Kitchen Ch. 16 & 19 for more details on this halacha.]

Q. If there is no lid on the pot, may the food be slightly inserted in the pot to heat up?

A. No. Only on top of a pot is permitted ((שם))

. However, if the lid is upside down and slopes slightly inwards, food may be placed there ((הגר”נ קרליץ שליט”א בחוט שני ח”ב עמ’ קל)) . Similarly, one may not place food directly inside the pot that is already on the blech even if one covers the food that is already in the pot with a layer of foil, since it is like placing it on a fire to heat up ((ארחות שבת עמ’ צט)) .

Q. May one place an empty pot/foil container onto the blech and heat up food on top of that empty pot/container?

A. Many Poskim say that one may only heat up food on top of a pot containing food, and not on top of an empty pot ((תו”ש ס”ק מב והפרמ”ג סי’ רנג א”א ס”ק לג, שכיון דאין דרך בישול בכך, אבל ע”ג קדירה ריקנית מועיל רק לדין הפסק וחשיב רק גו”ק. והמקור לשאלה זו היא הבה”ל ס”ג שהקשה למה כאן בס”ג לא התיר השו”ע בהפסק קדירה ריקנית ולקמן בס”ה מתיר ליתן לכתחילה? ותירץ ששם הוי על קדירה מלא תבשיל שלא נחשב כעומד על הכירה אבל כאן הקדירה ריקנית ועומד שם רק לסתם חום הכירה לכן אסור לכתחילה. וכ”ה בחזו”א סי’ לז ס”ק ט ד”ה הקשה, כיון שהקדירה ריקנית משמש האש ובטל אצלו וכאילו אינו, הגרי”ש אלישיב שליט”א הובא בארחות שבת עמ’ ק, שו”ת אז נדברו ח”ג סי’ יד שכתב שאם ישים ב’ דברים שעושים זה כגו”ק היאך יהי’ בזה כדין הקדירה מלא)) . However, other Poskim contend that food may be heated up on top of an empty pot that is on a blech ((ואע”ג שבס”ג מיירי בקדירה שכבר מונח בכירה לפני שבת, וההפסק קדירה רק עשה את הכירה לגו”ק אבל עדיין אסור ליתן לכתחילה, הגרש”ז זצ”ל שהובא בשש”כ הע’ קיב ותיקונים ח”ג כתב שהבה”ל לא איירי שיש בלעך, אבל אם יש בלעך על האש, מותר לכתחילה ליתן קדירה ריקנית וליתן עליו מאכל יבש שנתבשל כל צרכו, וזה נכלל בהיתר הפסק קדירה כיון שאין דרך בישול בכך. וכן פסק שו”ת שבט הלוי ח”א סי’ צא. אבל הגריש”א שליט”א הובא בס’ שבת בשבת עמ’ רנ כתב שלא דמי אלא לב’ כיסויים דלא מהני. ועי’ סוף הע’ קודם שכ”כ האז נדברו)) .

Q. What if one places an empty pot/container on top of a hot-plate, may one heat up food on that empty pot/container?

A. According to most opinions: yes ((ולא מבעיא לשיטות שסוברים שמותר להניח על קדירה ריקנית שעל הבלעך ממש (הגרש”ז), אלא לענ”ד שאפשר אפי’ להמחמירים שצריך קדרה מלאה זהו דוקא על הבלעך שהוא בעצם מקום בישול, אבל על הפלטה חשמלי שרוב סוברים שזה נחשב לגו”ק וגם אינו מחזי כבישול כ”כ כמו הבלעך על האש אפשר שהם יסכימו שמותר אפי’ על קדירה ריקנית. וכן שמעתי מהגרפ”א פאלק שליט”א שמחמיר בקדירה ריקנית על הבלעך ומיקל אם זה על הפלטה חשמלי. ואח”כ ראיתי בס’ שבת בשבת עמ’ רנ שכתב שאע”פ שהפלטה יש סברא להחמיר טפי כיון שהפלטה עצמו הוי אש ואין זה אלא כקדירה ריקנית שע”ג האש, אולם יש לצרף סברת הר”ן והרבה אחרונים שמיקלים בדבר יבש לכתחילה, שדוקא בדבר יבש יש להקל. אבל למעשה עיין מש”כ לעיל שהרבה פוסקים סוברים שהפלטה אין זה מקום לבישול ואינו מיחזי כבישול ע”כ זה וודאי מותר ע”י קדירה ריקנית. וע”ע לקמן בשם הגרח”פ שיינברג שליט”א שמתיר להניח תבשיל יבש על הפלטה עצמו בלי שום הפסק)) . Q. May a fully cooked, dry food be placed on top of a hot water urn to heat up?

A. Yes, since it is not a normal place to cook, it does not resemble cooking ((ספר שבת כהלכה ח”א עמ’ תא)) .

Q. If one has two pots on the blech, one on top of the other, may one place a dry, fully cooked food inside the top pot to heat it up on Shabbos?

A. Yes, since it is not a normal place that one cooks in ((ספר מאור השבת סי’ ב ס”ק טז.)) . However, if the pot is made in such a way that the bottom of the top pot serves as a lid to the lower pot e.g., a vegetable boiler, it is forbidden since this is the normal way to cook in this pot ((ספר שבת כהלכה ח”א עמ’ תד)) .

Q. May the food that is being heated up on top of a pot be wrapped in aluminum foil?

A. This may pose a problem of hatmana (insulating) [see page 83]. If it is wrapped in one layer of aluminum foil, it is permitted ((עי’ סי’ רנז ס”ב. ועי’ שו”ת מחזה אליהו סי’ לב שהביא מהחזו”א סי’ לז ס”ק לב שזה לא נקרא הטמנה ע”ש הטעם. וכ”כ הגרי”ש אלישיב שליט”א הובא בשבות יצחק עמ’ רנז והגרי”י פישר זצ”ל בס’ מאור השבת ח”א עמ’ פד שכיסוי אחד לא נחשב כהטמנה אף דעוזר לחימום התבשיל. ואע”פ שיש אומרים שהאג”מ אוסר בזה, הבעל מחזה אליהו כתב שאפי’ האג”מ מיקל בזה וע”ש עוד)) .

Q. If a pot was placed on top of another pot that was on the blech/hotplate (even before Shabbos), and the lower pot was later removed on Shabbos, may the upper pot be placed directly onto the blech/hotplate?

A. No. Since being on top of another pot is not considered as being on the blech, placing it now on the blech is like first placement which is forbidden ((חזו”א סי’ לז ס”ק יא ד”ה מן האמור, דחשיב כשהייה ראשונה)) . However, if one were to place the top container onto the actual blech or hotplate before Shabbos – even for a moment – and then onto the lower pot, it may now be lowered to the blech itself on Shabbos, since this is considered chazara and not first placement ((ס’ זכור ושמור (לבעל המחזה אליהו) שיש נוהגין להקל בזה וכן הוא עצמו אמר לי שיש להקל בזה אפי’ לכתחילה, וכן מצאתי סברא כעין זה בשו”ת אור לציון ח”ב פ”ל אות ט, ואפשר שהוא כתב זה לשיטת בני ספרד משום שכתב שם “שהרי לא הנוחה ע”ג קרקע”. ושמעתי מפי הגר”ע אויערבאך שליט”א שאין עצה זו מועלת כלום)) .

This is because placing a pot on top of another pot which is on the blech is not like placing it on the counter, since a counter is a place that one places pots that is finished cooking on the fire, and one doesn’t normally place them on top of other pot that are still on the fire. Thus, it shows that he hasn’t finished with this pot on the fire yet. This is similar to holding the pot in one’s hand the entire time it is off the fire making it permissible to return to a covered flame [see below page 43 – conditions].

  1. 2. On a radiator

Another method of reheating fully cooked dry food on Shabbos is on top of a radiator. Since no-one cooks on a radiator, it does not resemble cooking and is therefore permitted ((ופשיטא דלא גרע מפאנדי”ש ע”ג קדירה. אג”מ ח”ד סי’ עד אות לד, שבט הלוי הובא בקובץ שיח תורה)) .

  1. 3. Near the flame – סמוך לאש

An additional method of reheating up dry food on Shabbos even though it was not on the flame when Shabbos began is to place it near the flame. It may only be placed in an area that if left there – even for a long time – would not reach the temperature of yad soledes bo [approx. 45°c] ((אג”מ ח”א סי’ צד, ח”ד סי’ עד אות לו, הגר”נ קרליץ שליט”א הובא בארחות שבת עמ’ צט, ס’ הלכות שבת (הגר”ש איידר זצ”ל) עמ’ 306. אבל החזו”א סי’ לז ס”ק ח מחמיר גם בזה. ואפי’ בתוך התנור שאינו יס”ב מותר לפי המ”ב ס”ק צב דאין שם תנור כלל, אבל הגר”ז בקו”א ס”ק ד מחמיר גם בזה ע”ש טעמו)) . It is forbidden to put a food, even for a moment, in a place that could eventually heat up the food to the temperature of yad soledes bo ((מ”ב סי’ רנג ס”ק טו, אג”מ שם)) .

Q. May food be placed on an electric stove that is currently off, but is set to switch on later (by a time clock)?

A. It depends when:

  • Before Shabbos – most Poskim hold that on Erev Shabbos, one may place a fully cooked dry food on an electric stove covered with a blech or hot-plate that will switch on by itself on Shabbos ((שו”ת הר צבי או”ח סי’ קלו, חזו”א סי’ לח ס”ק ב (ואע”פ שמוכח מהחזו”א דאסור, זה רק אם אינו גו”ק, אבל אם הכירה גו”ק משמע דמותר), ומותר כיון שעשה מעשה הנתינה ע”ג כירה מע”ש ולא חשיב כמשהה לכתחילה בשבת, וכן פסק שו”ת מלמד להועיל ח”ג סי’ נח, שו”ת שבט הלוי ח”ט סי’ נא, הגרי”ש אלישיב שליט”א הובא באוצרות שבת עמ’ תד, חוט שני עמ’ קלג, שש”כ פ”א סעי’ לב. ויש מחמירים בזה, שו”ת חלקת יעקב ח”א סי’ נז, שו”ת צי”א ח”ב סי’ ו, שו”ת מנחת יצחק ח”ד סי’ כו אות י [לב]. ועי’ ס’ הל’ שבת (להגר”ש איידר זצ”ל) שמשמע שמותר ליתן אפי’ לח שנצטנן (דהיינו שמבושל כבר פעם א’) כיון שאין מעשה בשבת עצמו יכול לסמוך על העיקר הדין שאין בא”ב בדבר לח. אבל בשו”ת שבט הלוי וחוט שני מחמירים בזה ורק דבר יבש מותר)) .
  • On Shabbos – most Poskim hold that on Shabbos it is forbidden to place even a fully cooked dry food on an electric stove that will be switched on shortly. This is as if it was placed on the fire for the first time on Shabbos ((שו”ת הר צבי שם, חזו”א שם ס”ק כא, הגרש”ז זצ”ל הובא בשש”כ ח”ג סכ”ו ושו”ש עמ’ ח”א עמ’ קד, שש”כ פ”א סכ”ו, מאור השבת ח”ד עמ’ קנ, ארחות שבת עמ’ קא. ושו”ת מנחת יצחק ח”ד סי’ כו כתב לאסור משום זילותא דשבת. וכן אם נתנו שם מע”ש והורידו אסור להחזירו לשם גם בשעה שאין הכירה מופעלת. ולפי הגרח”פ שיינברג שליט”א לעיל זה מותר)) .

 

One may, however, ask a non-Jew to place fully cooked dry food on a stove or hot-plate that is due to go on soon ((שש”כ פ”א סעי’ לב)) .

Hot Plates

Q. May food be placed directly onto a hot plate on Shabbos?

A. As stated above regarding the halachos of שהייה (page 25), hot plates that have no adjustable control knobs have a status of a covered flame, thus, there is no concern that one may “stoke the fire” ((שו”ת הר צבי או”ח ח”א סי’ קלו, אג”מ ח”ד סי’ עד אות לה, הגרש”ז זצ”ל הובא בשש”כ פ”א הע’ עא, צי”א ח”ח סי’ כו, שו”ת שבט הלוי ח”ה סי’ ל, זו”ש עמ’ 54, ברית עולם הל’ שהייה אות כו, שו”ת תשובות והנהגות ח”א סי’ רז, שו”ת באר משה ח”א קונ’ אלקטריק ס”ב, הגרי”י פישר הובא במאור השבת ח”ד עמ’ קמו, שו”ת אור לציון ח”ב פי”ז אות א)) .

Regarding the halachos of chazara, some are of the opinion that since a hot plate is generally used just to keep food warm, placing food onto them doesn’t resemble an act of cooking and may be done on Shabbos (provided the food is dry and fully cooked) ((שמעתי מהגר”א פרץ שליט”א שהגרח”פ שיינברג שליט”א סובר שמותר לכתחילה להניח אוכלים ישר על הפלאטה בשבת (אם נתבשל כל צרכו ויבש וכו’) שהוא מדייק מהמ”ב שכתב בסי’ רנג ס”ק נח “כדרך שמבשלין בה תדיר”, ופלטה של שבת אין מבשלין בה תדיר!. וכן שמעתי בשם הגר”ע יוסף שליט”א. וע”ע באג”מ ח”ד סי’ עד אות לה שכתב “שאם א”א להתבשל שם אז מותר להעמיד קדרה חמה”, ומשמע שחולק על השיטות הנ”ל)) . Most Poskim hold that since it can, and sometimes is used to cook foods or heat up liquids (which is tantamount to cooking them), placing food on a hot plate looks like an act of cooking ((הגרש”ז זצ”ל הובא במאור השבת סי’ י ס”ק ד, הגרי”ש אלישיב שליט”א הובא בשבות יצחק עמ’ קג, הגר”ש וואזנאר שליט”א הובא בקובץ שיח תורה ושבת בשבת עמ’ רמד, זו”ש עמ’ 54, שש”כ פ”א סכ”ה [ל]. ועי’ ס’ שבות יצחק שכתב שכאן בא”י חזינן שיכולות להרתיח תבשיל צונן לכן י”ל דאסור. וכעין זה כתב הגרי”ש אלישיב שליט”א (שם) דכיון דאם יניח דבר לח יוכל לבא לידי יס”ב הם בכלל כירה לאיסור חזרה)) .

Therefore, according to most opinions, one may not place even fully cooked dry food directly onto a hot plate to warm up on Shabbos.

Q. Is there a permissable way to warm up fully cooked dry food on a hot plate on Shabbos?

A. Yes. As explained earlier, placing food on top of another pot/container (even if the container is empty according to many Poskim) does not resemble an act of cooking. Consequently, one may heat up a piece of chicken or kugal on top of a cholent pot that is on a hot plate or on top of an overturned empty aluminum foil container or overturned pot lid.

תנאים לחזרה – Conditions that Permit Returning Food

As stated above, Chazal forbade returning food to its source of heat on Shabbos. One of the main reasons given is because it looks as if one is cooking on Shabbos. However, if it is 100% evident that he is only re-warming up the food and not cooking it, then the food may be returned on Shabbos.

In order to accomplish this, three conditions need to be fulfilled:

  1. דעתו להחזיר – Intention to replace it,
  2. עודה בידו – Still in one’s hand ((ודעת המחבר בזה סי’ רנג ס”ב דהכל תלוי אם הניחה ע”ג קרקע,דבהניח הקדירה ע”ג קרקע אף שהיה דעתו להחזירה בטלה לה שהייה הראשונה ואסור להחזירה, ודעת הרמ”א דבעינן שלא יסיר הקדירה מידו ודעתו להחזיר. ועי’ רמ”א שם שהביא דעת הר”ן בשם הירושלמי שסובר שרק צריך דעתו להחזיר ועודו בידו אם נטל הקדירה לפני שבת ולא החזירו עד שחשיכה, אבל אם נטל הקדירה בשבת ובא להחזירו, אי”צ תנאים אלו, והרמ”א סיים ע”ז וטוב להחמיר. וכתב המ”ב שהרבה פוסקים חולקין על הר”ן. אבל פשוט שבמקום צורך יש לסמוך על דעת הר”ן כדהלן)) ,
  3. אש גרוף וקטום – The flame is covered.

This covers all three “partners” involved in the process of returning the food: one needs intention, the pot still needs to be in your one’s, and the fire needs to be covered.

Obviously, besides the above mentioned conditions, in order that one shouldn’t transgress the melacha of bishul – cooking, the food must be:

  1. מבושל כל צרכו – fully cooked,
  2. חם – hot i.e., yad soledes bo [approx. 45°c] or comfortably warm (( וסימן הוא “גנב חד” = גרוף וקטום, נתבשל כל צרכו, בידו, חם, דעתו להחזירו. ותנאי זה שהתבשיל צריך להיות חם שאינו דוקא בתבשיל לח, אלא לכמה פוסקים ג”כ בתבשיל יבש אע”פ שאין בו חשש בישול, ועי’ לקמן עוד בדין זה בהע’ 151.)) .

1) דעתו להחזיר – Intention to replace it:

 

When removing food from the source of heat, one must have intention to return it. Once one has this intention, the removal of the pot is considered a mere interruption of the שהייה that was done before Shabbos and returning it is a continuation of that שהייה.

v    According to Sefardim, this condition is not required ((שו”ע סי’ רנג ס”ב, סתם כהרמב”ם שהכל תלוי אם הניח ע”ג קרקע)) .

Q. Does one require explicit intention to return it, or is it sufficient if he did not have specific intention not to return it?

A. Although there is an opinion that holds that one needs explicit intention ((הגראמ”מ שך זצ”ל באבי עזרי פ”ג. וז”ל שם “שהעיקר הוא בעת הנטילה מן הכירה אם היה דעתו להחזיר אז מותר, ואם אין דעתו להחזיר אח”כ, כשהחזיר הרי זה כמו ששם מתחילה ואסור” משמע שסובר שצריך מחשבה חיובית להחזיר, ובלי זה אסור)) , most Poskim hold that as long as one did not have intention not to return it, it may be returned to a covered flame ((הגרעק”א הובא בבה”ל שם (עפ”י האבי עזרי בכוונת הגרע”א) דעיקר מה שמבטל השהייה הוא מה שאין הקדירה על האש אלא שכ”ז שעודה בידו לא חשיב כנסתלקה מן האש לגמרי, וכדי לאסור החזרה צריך שיחשוב בדווקא שלא להחזיר, דאז מחמת מחשבתו הוי סילוק גמור מן האש, אך לא בעי’ מחשבה חיובית להחזיר (וע”ז חולק האבי עזרי), וכ”כ הגרש”ז זצ”ל במנחת שלמה, והגרפ”א פאלק שליט”א בזו”ש. ושמעתי מהגר”א גרוסמן שליט”א (מח”ס שו”ת ודרשת וחקרת) ששמע מהגרי”י פישר זצ”ל שיכול אדם להתנות פעם בשנה שכל פעם שאני מוריד קדירת שבת כוונתו להחזירה, וזה מועיל)) . Consequently, any time one removes a pot without any specific intention, it may be returned.

There are several differences that result from these two opinions. For example:

  • If one removed the pot without any intention,
  • If the pot fell down by itself,
  • If the fire under the pot went out.

In all of the above cases, it depends if one requires explicit intention or not. The halachos in the above cases will be discussed below.

Q. What if one removed the pot specifically intending not to return it, and subsequently changed his mind to return it – may he do so?

A. If the food is very much needed, it may be returned (provided that the other conditions are fulfilled, fully cooked, hot etc.) ((מ”ב ס”ק נו ובה”ל שם. ובחזו”א סי’ לז ס”ק יב ד”ה ונראה דאין מקום להוסיף שיש לצרף גם שיטת הר”ן שכל התנאים להתיר חזרה לא איירי אלא בנוטל מבעו”י ומחזיר משחשיכה ע”ש))

2) עודו בידו – Still In One’s Hand:

The second condition required in order to be able to return food to the fire on Shabbos is that it stays in one’s hand the entire time that it is off the fire. Doing this shows that it was never actually disconnected from the fire, and when one returns it he is just continuing the original שהייה that was done before Shabbos.

v    According to Sefardim, this condition is not required (provided it is not placed on the floor or in the fridge) ((שו”ע סי’ רנג ס”ב. ופסק בס’ התרומה שצריך או דעתו להחזיר או בהנחה ע”ג קרקע, וכ”כ הר”ן ורא”ה והריטב”א. אבל הרמב”ם נקט שהכל תלוי אם הניחו ע”ג קרקע ולא חילק אם דעתו להחזיר או לא, ושו”ע סתם כהרמב”ם)) .

Q. Does this mean that it must be held up in the air the whole time?

A. Many Poskim hold that even if the pot/container is resting fully on the counter, it is sufficient that one hold onto one of the handles ((אע”פ שהרמב”ם בפירוש המשניות כתב וז”ל “שתהיה באויר עד שישפך ממנה ויחזירנה” מבואר דבעי’ שתהא באויר דוקא. מ”מ הרמב”ם בחיבורו פ”ג ה”י פסק לקולא אם הניחה ע”ג ספסל ע”ש, וצ”ל שהרמב”ם בחיבורו נקט ספיקת הגמ’ בדף לח: לקולא, ואילו בפיה”מ נקט ספיקת הגמ’ לחומרא, וזו היא דעת הרא”ש וכפסק הרמ”א. וכ”כ באג”מ ח”ד סי’ עד אות לג, מיהו מסיק שהרמב”ם פ”ג ה”י לא הזכיר שתהיה באויר ומשמע שהוא מתיר, וכ”כ להקל הגרפ”א פאלק שליט”א בזו”ש, וכן אמר לי הגר”ע אויערבאך שליט”א)) . There is an opinion that  the pot needs to be partially in the air and partially on the counter to be considered “still in one’s hand” ((הגרי”ש אלישיב שליט”א הובא בס’ שבות יצחק פרק יד. ואפי’ לפי המחמירין אם בעת הצורך כגון שהוא יחידי ואין באפשרותו להחזיק הקדירה באופן זה, מותר לו להוריד הקדירה מהאש ולהניחה ע”ג השיש אם דעתו להחזירו כיון שזה עת הצורך כמש”כ המ”ב ס”ק נו. ואולי בכה”ג עדיף להוציא מהקדירה בעודה על האש כמבואר בחזו”א, וצ”ע)) .

Q. What if one placed the pot on the floor?

A. It may not be returned to a covered flame on Shabbos even if one intended to return it ((שו”ע סי’ רנג ס”ב, ואפי’ אומר שאינו מסיח דעתו לא מהני, בה”ל שם. ועי’ לבוש שכתב הטעם משום “כאילו הסיח דעתו מלהחזירה” ממילא צ”ל שאפי’ להלבוש ג”כ אסור משום שבדרך כלל יש בנתינה ע”ג קרקע היסח הדעת מלהחזיר לאש ולא חילקו חכמים בדבר ואסור אפי’ אומר שאינו מסיח דעתו, וכ”כ בחידושי הר”ן שבת דף לח. ד”ה אמר רב ששת)) . However, if one intended to return it to a hot-plate, one may be lenient and return it (provided the other conditions were fulfilled), even though it was placed on the ground ((הגרש”ז זצ”ל בשש”כ ח”ג (תיקונים) הע’ עא, שהרי עיקר איסור נתינה לכתחילה בפלטה חשמלי אינו ברור כ”כ. וכ”כ ילק”י כרך א עמ’ תקלו. ועי’ ס’ שבת בשבת עמ’ רכט בשם הר”ן והתשב”ץ שאם מניח ע”ג קרקע ונותנו ע”ג דבר המפסיק בינו לקרקע כגון שנותן הקדירה ע”ג צלחת או כר, לא חשיב כמניח ע”ג קרקע. ומצטרף הרמ”א בסו”ס רנג שמקילין בהניחו ע”ג קרקע ודוקא בדעתו להחזיר, ע”ש עוד)) .

Q. What if it was placed on the floor, but one didn’t leave go of it the entire time?

A. It is still forbidden to return it on Shabbos ((ירושלמי פ”ג ה”א הובא בביאור הגר”א ס”ב “הניחו בארץ אסור לטלטלו תלוי ביתד אם היה חם מותר, א”ר יוחנן בשלא העביר ידו ממנו אבל אם העביר ידו ממנו אסור. שו”ת מהר”ם שיק סי’ קיז)) . This is because the floor is a place that pots are left off the fire, so holding onto the pot does not show one’s intention to return it. However, if part of the pot was on the ground and part was still in the air, one may be lenient and return it ((הגרי”ש אלישיב שליט”א הובא בשבות יצחק פי”ד, ארחות שבת עמ’ פד)) .

Q. What if there is a carpet on the floor?

A. It is still considered as placed on the floor ((הגרי”ש אלישיב שליט”א הובא בשבות יצחק שם עפ”י הר”ן שם כיון שבטל לקרקע)) .

Q. What if the pot was placed into a fridge?

A. It is as if one placed it on the floor. ((זו”ש עמ’ 43, כיון שהסיח דעתו מלהחזיר))

Q. What if this is the only hot food that was prepared, or guests are due to arrive and one will be embarrassed without this food (e.g., the cholent was taken off Friday night and placed on the ground and it is needed for the day seudah)?

A. One may be lenient if one had intention to replace the food when he removed it ((הגרי”ש אלישיב הובא בשבת בשבת עמ’ רל, שסומך על שיטת הר”ן דכל האיסור דוקא בנטלו מבעו”י ומחזיר משחשיכה, וכן פסק הרמ”א שכן המנהג, ורק סיים טוב להחמיר, פשוט שבמקום הדחק אי”צ להחמיר)) .

Q. What if the pot or container fell down on the floor?

A. According to most Poskim, it may not be returned to the blech even if one had intention to return it (except in great need) ((כתב הגרי”ש אלישיב שליט”א הובא בס’ שבות יצחק עמ’ קעז דכל שמחזיר הקדירה מן הקרקע הוי כשהייה חדשה ואין נפק”מ איך הגיעה לקרקע, וכ”כ הגרח”ק שליט”א הובא בס’ עם מקדשי שביעי שאפי’ אם נפל מעצמו הוי סילוק. ואם הוא במקום הצורך ודחק, יש מקום להקל ולהחזיר הקדירה בצירוף דעת הר”ן)) . However, one may be lenient and return it to a hot-plate ((בצירוף דעת הר”ן. וכ”כ להקל הגרש”ז זצ”ל הובא בשש”כ [חדש] פ”א הע’ פג משום שעיקר איסור של נתינה לכתחילה בפלטה לא ברור כ”כ. וע”ש שכתב דאפשר דפלטה חשמלית מיוחדת לשבת דומה להא דמעזיבה בסי’ רנד במ”ב ס”ק פא שאינה באה אלא לשמור על החום ויהיה מותר אפי’ לכתחילה להניח עליה קדירה בשבת, ומה שמחמיר שם בשם המהרי”ל הוא רק כדי שלא יבואו לחתות. ובפלטה אין שום חשש של חיתוי ומ”מ טוב להחמיר מליתן, אבל אם הניח ע”ג קרקע שפיר יכול להחזיר)) .

Q. What if one placed the pot on the counter and let go of it; may it be returned?

A. A similar question is discussed in the Gemara ((שבת לח: “הניחן ע”ג מטה מהו” ומסיים שם תיקו. דבזמן הגמ’ הניחה ע”ג קרקע היה נחשבת כמעשה סילוק מן האש, והנחה ע”ג כסא וספסל לא היה סילוק. והטור סי’ רנד מסיק להחמיר אבל השו”ע לא הזכיר זה)) regarding placing a pot on a bed or bench (they didn’t have counters then). The Gemara does not resolve this question.

The essence of the question is do our counters have a status of a bed/bench which is considered like a temporary place on which one puts pots, or is a counter comparable to placement on the floor, and is thus a complete disconnection from the flame and it would therefore be forbidden to later return the pot to the fire ((ונראה שהשלחן שאוכלים עליו לא גרע ממטה או ספסל, ורק השאלה היא על השיש שגרע טפי. ועי’ ס’ מנוחת אהבה (להגר”מ לוי זצ”ל) הובא בס’ שב”ש שהביא מפתח הדיבור דס”ל שמחובר לקרקע דינו כקרקע ועפ”ז כ’ להחמיר, ועי’ ס’ שב”ש עמ’ רכח שחולק עליו)) .

  • Some Poskim hold that our counter has a status of the floor ((כיון שהוא מקום שרגילים לסלק לשם קדרה לאחר שמסירה מן האש, הגר”ש ואזנר שליט”א הובא בסוף ס’ ארחות שבת עמ’ תקטז. וכ”כ הגר”ש אויערבאך שליט”א הובא בארחות שבת עמ’ פו, אור לציון פי”ז ס”ק ו. וכן שמעתי כמה פעמים מפי הגר”ע אויערבאך שליט”א)) . Thus, the pot may not be returned to a covered flame (unless in a great need).
  • However, many Poskim hold that a counter has a status of a bed/bench ((אג”מ ח”ב סי’ סט בצירוף הי”א ברמ”א, הגרש”ז זצ”ל הובא בשבות יצחק פי”ד, שו”ת אז נדברו ח”ח סי’ יז, הגר”ח קניבסקי שליט”א הובא בס’ עם מקדשי שביעי, הגר”ש איידר עמ’ 352, ס’ שבת בשבת עמ’ רכח בשם הגרי”ש אלישיב שליט”א והגרש”ז זצ”ל)) . Thus, if a pot was placed on a counter and one let go of it, it may be returned to a covered flame providing he had this intention when removing it ((ולדעת החזו”א סי’ לז ס”ק יב יש מקום להקל במקום הצורך אם נטל הקדירה בשבת גם בשלא היה דעתו להחזיר)) .

Q. Is giving the pot to someone else to hold still considered as if it was “still in his hand”?

A. This is considered as if it is still in his hand ((שמעתי מהגרפ”א פאלק שליט”א והגר”ע אויערבאך שליט”א. ועי’ ס’ שבת בשבת עמ’ רכה בשם מקור חיים לבעל החוו”י שמחמיר בזה, דמש”כ הרמ”א ועודו בידו לאפוקי אם ניתנה לאחר.)) . It is also permitted for one person to pass it from hand to hand.

Q. What if one kept holding on to the lid, but placed the pot itself down, is this considered “still in his hand”?

A. No, the pot must be in his hand ((שו”ת שבט הקהתי ח”ג סי’ קב)) .

3) אש גרוף וקטום – A Covered Flame

 

The third condition required when intending to return a pot to the flame is that the fire must be covered ((משנה ריש פרק כירה דאף בחמין שהתבשלו כ”צ, ובתוס’ שם ד”ה חמין דאף דמצטמק ורע לו אין מחזירין אלא ע”ג כירה גו”ק, וברמב”ן ור”ן שם וכ”כ הרמב”ם דלעולם אף מה שמותר להשהות, אין מחזירין אלא ע”ג כירה גו”ק)) (גרוף וקטום). This accomplishes two things:

a)  It no longer appears as if one is “cooking” when placing food on it.

b)  He will be reminded not to adjust the flame to heat up the food that may have cooled down slightly,

This means, that even if a fully cooked, hot food was taken off the fire with intention to return it, and was kept in the hand whilst it was off the flame, it still may not be placed on an uncovered flame on Shabbos.

Consequently, the reason to cover the flame in order to return cooked food is somewhat different to the reason stated earlier that a covered flame allows uncooked food to remain on a flame from before Shabbos. The reason for covering the flame to allow uncooked food to remain on the fire is to prevent one from stoking the fire in a moment of panic, whereas the reason to cover the flame to allow foods to be returned on Shabbos is – according to most opinions – so it should not appear like an act of cooking.

Q. Is covering a gas stove or electrical cooker with a blech sufficient for this?

A. Yes, according to most Poskim ((שו”ת זרע אמת רנז כו, מהרש”ג ח”ב סי’ נ, חיי”א כלל כ יב, צי”א ח”ז סי’ טו, אג”מ ח”א סי’ צג, כה”ח ס”ק יא, שבט הלוי ח”א סי’ צא, זו”ש עמ’ 38, וכן מנהג ירושלים (שש”כ פ”א הע’ נד). אולם החזו”א סי’ לז אות יא חולק ע”ז וסבר שהבלעך נחשב ככירה שאינו גו”ק, משום המרדכי שהוא מקור לדין זה כתב אם נתן קדירה ריקנית על הכירה, הוי כגו”ק. וכתב החזו”א שהמרדכי מיקל רק בקדירה ריקנית משום ממעט החום ע”י הקדירה, אבל הבלעך לא ממעט החום כלל והמאכל כאילו על האש ממש, וגם לא דמי לקדירה ריקנית דהוא שינוי שאין דרך בישול בכך, משא”כ בבלעך. לכן, לפי החזו”א חזרה לבלעך אסור. וע”ע בחוט שני ח”ב עמ’ קיא הערה חשוב בדעת החזו”א מעת הגר”נ קרליץ שליט”א. ולפי החזו”א אם רק הטיה הקדירה ולא להערות את הקדירה ממש מותר להחזיר הקדירה אפי’ לבלעך ולא נחשב כחזרה (הובא בס’ עם מקדשי שביעי)) . A blech permits returning food on Shabbos (as long as the other conditions are met, e.g., fully cooked, hot, still in hand etc.). It is preferable that the knobs/switches also be covered (( אג”מ או”ח ח”א סי’ צג ד”ה “ולפ”ז”.)) .

Q. Does a hot plate require a blech?

A. It depends:

  • A non-adjustable hot-plate does not require any covering ((שו”ת הר צבי או”ח ח”א סי’ קלו, אג”מ ח”ד סי’ עד אות לה, הגרש”ז זצ”ל הובא בשש”כ פ”א הע’ עא [פג], צי”א ח”ח סי’ כו, שו”ת שבט הלוי ח”ה סי’ ל, זו”ש עמ’ 54, ברית עולם הל’ שהייה אות כו, שו”ת תשובות והנהגות ח”א סי’ רז אות ו, שו”ת באר משה ח”ו קונ’ אלקטריק ס”ב, הגרי”י פישר הובא במאור השבת ח”ד עמ’ קמו, שו”ת אור לציון ח”ב פי”ז אות א)).
  • An adjustable hot-plate requires a covering ((שו”ת הר צבי או”ח סי’ קלו, שו”ת באר משה ח”ו בקו’ אלקטריק ס”ב, חוט שני עמ’ קטו, זו”ש עמ’ 55, אור לציון ח”ב פי”ז אות א, מאור השבת ח”ד עמ’ קמה. ואף שחוטי החשמל שבמכשיר מכוסים זה לא מספיק כיון שזה דרך תשמישן ואין זה היכר כ”כ, ס’ מאור השבת ח”ד עמ’ קמה, ארחות שבת עמ’ סז בשם החזו”א)) .  A layer of thick aluminum foil is sufficient.

Q. Do crock-pots require a covering?

A. Yes. In order to return the inner pot which contains the cholent in it on Shabbos into the outer pot, the entire inside of the outer pot must be lined with aluminum foil (acc. to some Poskim, two layers). This is true even if it has only one heat setting, since people use crock-pots for cooking ((כן שמעתי מהגרפ”א פאלק שליט”א)) .

[See below – page 107 where we explain that many Poskim advise that the inner pot should be raised slightly in order that there should not be a problem of hatmana – insulating.]

4) מבושל כל צרכו – The Food Must Be Fully Cooked

In order to be able to return food to the blech/hotplate on Shabbos, the food must be fully cooked ((ואפי’ אם מצטמק ויפה לו מותר. ואע”פ לפי שיטת הרמב”ן, הרשב”א והרא”ש, כיון שהגיע למב”ד אין חייב עוד משום בישול, אנן מחמירים כשיטת הרמב”ם שאפי’ אחרי שהוא מבושל כמב”ד, חייב, וכן פסק השו”ע ורמ”א בסי’ שיח)) . A food that is not 100% cooked may never be returned to a source of heat on Shabbos.

One should be aware when removing the cholent pot or lifting up the lid on Friday night to check it that it is fully cooked (including the bones acc. to some Poskim ((עי’ מנחת שלמה  ח”א סי’ ו, אג”מ ח”ד סי’ עו-עז, ארחות שבת ח”א פ”א דין לג, תשובה מהגרח”פ שיינברג שליט”א מובא בס’ קובץ זכרון לר’ זולטי, ואין כאן מקומו להאריך)) ) before returning it/replacing the lid.

5) חם – The Food Must Still Be Hot.

 

Liquids

 

A liquid may only be returned to a source of heat if it was fully boiled and is still hot.

If a liquid has cooled down, it has lost its status of “cooked”. Thus, re-heating it is considered cooking it and is forbidden on Shabbos ((ריטב”א שבת לח: “שיחזירנה למקומה קודם שתצטנן לגמרי דלא ליחזיי כמבשל”, וזה אף לשיטות שסברים בלח שיש בו מרק אין בא”ב, אך עכ”פ מיחזי כמבשל, ועי’ לקמן דיני יבש. וכ”ה שו”ע סי’ שיח ס”ד עפ”י הרא”ש. ועי’ בפרמ”ג שם בא”א ס”ק לט שכתב אם נצטנן עד שאין ראוי לאכול אסור דנראה כתיקון קצת. וע”ע בחיי אדם כלל כ בנשמ”א אות ח, ערוה”ש ס”ק לא)) . Therefore, if one removed a liquid (or food containing a liquid) from the blech on Shabbos, and the liquid has cooled down while serving it, it may not be returned to the blech/hotplate on Shabbos.

Q. What is the heat that is considered hot enough that it can be returned to the blech?

A.

  • According to Ashkenazim, if the liquid is warm enough that it can still be enjoyed as a warm drink it may be returned to the blech ((רמ”א שם סעי’ ט”ו “אם לא נצטנן לגמרי”. וכ”כ גר”ז שם, אגל”ט ס”ח, אג”מ ח”ד סי’ עד אות ב, הגרש”ז זצ”ל בשש”כ ח”ג (תיקונים) ס”ט. וע”ע בחזו”א סי’ לז ס”ק יג ומעיקר הדין אין שום מקום לחלק בין נצטנן לגמרי ללא נצטנן לגמרי דכל שאין יס”ב חשוב מן הדין כצונן, וע”כ שאנו תופשין לעיקר הדין כדעת הרמב”ם והרשב”א והר”ן שאין איסור לחמם את הצונן שמבושל אלא מפני שלא יבאו להקל בשאינו מבושל, לא נהגו היתר בצונן שאין חמימות ניכרת ואפשר דהוא משום גדר חזרה. וס’ שבות יצחק ח”ט עמ’ שעג הביא בשם הגרי”ש אלישיב שליט”א שהשיעור הוא חם יותר מחום הרוק.))
  • According to Sefardim, if the liquid is under yad soledes bo it may no longer be returned to the blech.

Q. May a Sefardi (i.e., that may not return liquid that is below yad soledes bo to a source of heat) give the warm liquid to an Ashkenazi (to return it)?

A. Some Poskim allow it ((הגרשז”א זצ”ל הובא במנחת שלמה חלק ב’ סי’ ל”ה אות י”ז, וז”ל שם “ובדבר השאלה, אם הנוהגים כפסק הב”י יכולים לומר להנוהגים כרמ”א בסי’ שי”ח סט”ו, שיניח עבורו תבשיל שלא נצטנן על האש. הוא מחלוקת קדומה כמו אם מי שנמנע מלעשן ביו”ט רשאי לכבד את חבירו בסיגריה הואיל והוא כן רגיל. ואם המחמיר סובר מכח הכרעתו דאסור מסתבר שגם צריך לחשוש ללפני עור אבל אם רק מחמיר על עצמו מפני מנהג אבותיו או רבותיו בכגון דא אין לחוש ללפני עור, כי גם זה שנוהג איסור יודע שחבירו אין צריך להחמיר כמותו וכל אחד כמנהג אבותיו”. וכ”כ בציץ אליעזר חי”ח סי’ ל”ב אות ד, וכ”ה במאור השבת ח”א עמ’ תקנב וז”ל “ובדומה למה שכותב המג”א שם בס”ק ל”ג להעושים ב’ ימים יוה”כ … יש לאסור להנוהג בהב”י לרמז לחבירו הנוהג כהרמ”א שיחם עבורו תבשיל זה שלא נצטנן לגמרי … אולם לענין לאסור בהנאה … דיעוין במ”ב בסימן שי”ח ס”ק ב’ שפוסק שכל שיש ספק פלוגתא בזה … אין לאסור בדיעבד וא”כ דון מינה דה”ה גם בכגון נידוננו, דאין לאסור לספרדי לאכול מזה, והדבריו עוד בק”ו, דהא האשכנזי לפי מעמדו ושייכותו הא מותר לו לבשל זה אפילו לכתחילה, וכשבא לשאול מורים לו להיתר, וא”כ בוודאי דלא נאסר זה בהנאה לספרדי המזומן לאכול אצל האשכנזי)) , however, others don’t allow him to ask explicitly, rather, if  the Ashkenazi does it, the Sefardi need not protest and may benefit from the hot food ((הגר”ע יוסף שליט”א הובא בילקוט יוסף שבת ח”ג סוף עמ ריט וז”ל “אם האשכנזי עושה כן מעצמו לצורך הספרדי, אין צריך למחות בידו”.וכ”ה בילקוט יוסף או”ח סי’ שיח עמ’ רטז “שמחזירים בשבת תבשיל לח … אך עדיין לא נצטנן לגמרי … דמאחר שהספרדי צריך לנהוג כדעת מרן השלחן ערוך, אין להקל לצוות לאחר לעשות לו דבר שבשבילו הוא איסור גמור. אלא אם כן האשכנזי עושה כן מעצמו, אף אם עושה כן לצורך בעל הבית הספרדי, שאין צריך למחות בידו)) .

Note: According to Ashkenazim, if a liquid is still warm and suitable for a warm drink, it may be returned to the fire. This is only permitted if the water was previously fully boiled. However, water that was heated up but didn’t boil, even if it is still warm enough to drink as a warm drink may not be returned in a way that will make it hotter. Similarly, if the water was fully boiled but then cooled down, even if it was warmed up on Shabbos in a permitted manner and even if it is now yad soledes bo, it may not be returned to a flame even with a blech on ((כיון דפקע בישולו כשנצטנן יש בו משום בישול. רע”א סי’ שיח. שו”ת אבני נזר או”ח סי’ קכט ס”ק ז, תהל”ד סי’ שיח ס”ק יז, חזו”א סי’ לז ס”ק יג, הגרי”ש אלישיב שליט”א הובא בס’ שבות יצחק ח”ט עמ’ שפ)) .

Solids

Q. Do dry foods also have to be hot when returning them on Shabbos?

A. Although not subject to the halachos of bishul (i.e., once a solid has been fully cooked, it may be re-heated in the same way that it was originally cooked), if it has cooled down, it loses its connection to the original placement, and returning it to the blech is considered first placement and is forbidden ((מוכח מהב”ח ועולת שבת, שלחן עצי שיטים, מג”א סי’ רנג ס”ק לו “דהוה ליה כמניח על הכירה לכתחילה”. וכ”כ בפרמ”ג א”א ס”ק לו, גר”ז ס”ק יח, א”ר אות לו, שבה”ש ס”ק יד. וכן פסק האג”מ הובא בסוף ספר הלכות שבת (ר’ איידר זצ”ל) שטוב להחמיר בזה כמג”א. ואע”פ שהמ”ב ס”ק סח הביא שיטת המג”א להחמיר בזה אפי’ בדבר יבש, אולם בס”ק צא ונד ובה”ל שם נטה לדעת הגר”א שאין צריך תנאי לזה. אבל למעשה כיון שדעת הב”ח ומג”א ועו”ש, וא”ר, ופרמ”ג, וגר”ז, ושו”ע עצי שיטים מחמירים בזה וכ”כ המ”ב, שיש להחמיר בזה)) .

If Conditions are Missing

We mentioned earlier that when one wishes to return food to a flame, in order that it shouldn’t look like one is cooking on Shabbos (or to prevent him from adjusting the flame), Chazal enacted five conditions that one must fulfill in order to return food to its original heat source:

Summary of the Conditions Required to Return Food on Shabbos:

  1. דעתו להחזיר – Intention to replace it,
  2. עודה בידו – Still in one’s hand,
  3. אש גרוף וקטום – The flame is covered.
  4. מבושל כל צרכו – fully cooked,
  5. חם – the food must be hot i.e., yad soledes bo [approx. 45°c] or comfortably warm.

Whether the food can still be returned on Shabbos if not all the conditions were fulfilled depends on which of them were missing:

The Last Three Conditions Missing

 

If any one of the last three conditions were missing, the food may not be returned back to the blech on Shabbos ((מ”ב ס”ק נב בשם אחרונים)) .

Consequently:

  • If the fire one wishes to return the pot to doesn’t have a blech, or
  • The food was not fully cooked when it was taken off the blech [e.g., cholent on Friday night], or
  • The food was cold ((מג”א סי’ רנג ס”ב הובא ג”כ במ”ב ס”ק סח וז”ל שם “דכיון שכבר נצטנן בטלה השהיה הראשונה והוי כנותן עתה מחדש בתוך התנור לזה אסור בכל גוני))  (or not warm enough to be enjoyed as a hot food/drink when wishing to return it).

In any of these situations, the food may not be returned to the blech/hot plate on Shabbos ((אפי’ במקום צורך, מ”ב ס”ק נב)) . If the food is fully-cooked, dry food, it may be placed on top of another pot, or an empty pot/tin foil pan that is on a blech to warm it up. See page 38.

The First Two Conditions

Q. What if one removed the pot with the intention to return it, but later let go of the pot (i.e., the second condition wasn’t fulfilled)?

A. If the pot was placed on a table or counter – not on the floor or in the fridge – in a case of need, it may be returned to the blech on Shabbos ((מ”ב ס”ק נו “עת הצורך”. וכ”כ בשונה הלכות שם. ועי’ אג”מ ח”ב סי’ סט ד”ה “ובאם” שמיקל אפי’ בלא עת הצורך משום שמצרף דעת הי”א (הר”ן) הובא ברמ”א שמשמע שהרמ”א בעצם פוסק כן בעצם רק שמחמיר שם מפני שהרבה חולקין על הר”ן)) . One must make sure that all the other conditions are fulfilled, i.e., the food is still hot, fully cooked etc.

Q. What if the pot was placed on the floor (e.g., in the succah) or in the fridge, may it be returned?

A. Even if all the other conditions were fulfilled, the pot may not be returned to the blech on Shabbos ((שעה”צ ס”ק נ.)) . If it is being returned to an electric hot-plate, some Poskim are lenient and allow one to return it ((הגרש”ז זצ”ל בשש”כ ח”ג סע”א, כתב שכיון שהאיסור של נתינה לכתחילה לא ברור כ”כ בפלטה ואפשר שמותר אפי’ לכתחילה, אפשר להקל כאן, ועי’ הע’ לעיל013. וכ”כ ילק”י כרך א עמ’ קג להקל בזה אפי’ לבני ספרד)) .

Q. What if the pot was removed with the intention of not returning it, but he did not let go of it the entire time?

A. In a case of need, it may be returned ((מ”ב ס”ק נו ועי’ בה”ל שם. וגדר “עת הצורך” הגר”ע אויערבאך שליט”א אמר לי שרק אם אין לו מאכל אחר חם  או שיש יש לו אורחים ויתבייש אם אין לו אוכל חשוב. וכ”כ בשש”כ. וכן סובר הגרי”ש אלישיב, הגרי”י פישר, הגרש”ז (הובא במאור השבת). והגר”נ קרליץ והגר”ח קניבסקי כתבו שאין גדר מסויים בזה ורק הכל לפי המצב והאדם)) .

Both Conditions Missing

 

Q. What if one removed a pot from the blech with intention not to return it and in addition, the pot was put down on a table; may it be returned on Shabbos?

A. There is an opinion that holds that even if both of these conditions were not fulfilled, the food may still be returned on Shabbos ((חזו”א. בצירוף דעת הר”ן הובא ברמ”א ס”ב)) . However many Poskim ((שש”כ פ”א ס”כ [כב], זו”ש עמ’ 44)) say that one may only rely on this if the hot food is very much needed, e.g., it is the main dish of the seudah.

Some Poskim say that it is best – when possible – to ask a non-Jew to return the pot in this situation since both conditions were absent ((

Q. What if the pot was removed before Shabbos with the intention of returning it straight away, but he only actually returned it after Shabbos began?

A. According to most Poskim, it may be returned on Shabbos, since this was his original intention when removing it ((פרמ”ג בא”א ס”ק לה בשם הפרישה ס”ק ז, גר”ז ס”ק יד כיון שלא בטלה עדיין שהייה ראשונה, שעה”צ ס”ק מד, הגרש”ז זצ”ל הובא בשש”כ הע’ קיא [קכה]. אולם החזו”א סי’ לז ס”ק יב ד”ה ונראה דאין המנהג כתב שאין להקל בכה”ג, שמחמיר כשיטת הב”ח ולבוש שמדייק בדברי הטור שכתב “אפי’ בשבת”, משמע שלפני שבת אסור, וכתב שכן משמע בתוס’ שבת לז ד”ה ובה)) .

Q. What if one accidently removed the wrong pot from the blech, e.g., on Friday night he removed the cholent instead of the chicken soup, may it be returned?

A. As mentioned earlier, this depends as to whether one requires explicit intention to return the pot at the time of removing it or not. According to the opinions that one does, since in this case he did not, it may not be returned. However, according to those who are of the opinion that one does not require explicit intention, the pot may be returned since he did not have negative intention not to return it.

Consequently, according to most Poskim, the pot may be returned to the blech on Shabbos ((כיון שלקח בטעות, המחשבה “דאין דעתו להחזיר” בטלה, והוי כדעתו להחזיר. ומקור לדין מחשבה בטעות לא הוי מחשבה הוא משנה במס’ תרומות פ”ג מ”ח שהמתכוון לומר תרומה ואמר מעשר וכו’ לא אמר כלום עד שיהא פיו ולבו שוין. ועי’ תוס’ פסחים סג. “המתכוון”. וכ”כ בשבה”ש ס”ק מז, הגרש”ז זצ”ל הובא בשש”כ ח”ג פ”א ס”כ [כג], הגרח”פ שיינברג שליט”א, שו”ת שבט הקהתי ח”ג סי’ קב. וע”ע במגילת ספר סי’ א אות יב שג”כ נוטה להקל בצירוף הר”ן וגם שלא הניח ע”ג קרקע ואין מחשבה חיובית ע”ש)) . Some opinions, however, do not allow the pot to be returned ((הגרי”ש אלישיב שליט”א הובא בשבות יצחק עמ’ קעד שתולה זה על דברי רע”א שסוף סוף דעתו שלא להחזיר ונטילת הקדירה הוי סילוק והפסק שהייה. וע”ש שמחלק בין אם הבעל הקדירה הסירה, לבין אם הוריד מישהו אחר שאז שיש להקל ע”ש הטעם. וכ”כ הגר”ח קניבסקי שליט”א הובא בעם מקדשי שביעי, שו”ת בצל החכמה ח”ד סי’ קלז אות יח. וגם שו”ת באר משה ח”ו סי’ קיג נוטה להחמיר אם הניח על השלחן ואין דעתו להחזיר. והגר”ש וואזנר שליט”א הובא בקובץ מבית לוי ח”ח עמ’ כא אות כ כתב שלכתחילה יניח הקדירה על קדירה אחרת העומדת ע”ג האש, וכשאי אפשר יש להקל להחזירו ע”ג האש שסומך על הר”ן)) .

Other Cases

Q. What if the flame/hotplate went out during Shabbos, may the pot/s be transferred to another blech/hotplate?

A. Most Poskim allow the pots to be transferred to another blech or hotplate provided that the food is fully cooked and is still comfortably warm (for Sefardim, it must be yad soledes bo) ((עפ”י המ”ב ס”ק נו ושעה”צ ס”ק מט. הגרש”ז זצ”ל בשש”כ פ”א הע’ סט [עט], הגר”ש אויערבאך שליט”א הובא בארחות שבת עמ’ פח, מגילת ספר סי’ א ס”ק יב, הגר”ש וואזנר שליט”א הובא בקובץ שיח תורה ב עמ’ יא, הגר”ש איידר זצ”ל עמ’ 358, וילק”י מיקל אם מחזיר לפלטה חשמלית כיון שאין מחזי כבישול שם)) . This is because even though the fire went out, one never had intention to remove the pot, and an actual act of removal was never done. On the contrary, he has intention for it to still be on the fire ((שש”כ ח”ג הע’ נ [עט] כתב שדומה לטלית שנפלה ותפילין שנשמטו ממקומו שאם אירע זה באמצע התפילה אין נוהגים לברך אע”פ שהשו”ע כתב לברך, והרבה פוסקים סוברים שאינו מברך עי’ רע”ק שם, פרמ”ג מהרש”ם תהל”ד כה”ח. וכ”כ בשו”ת באר משה, שלחן גבוה שהמנהג שלא לברך [אבל לפי המ”ב גר”ז חי”א קצשו”ע, מברך], משום שבתחילת הלבישה ודאי היה דעתו להיות לבוש בהם כ”ז התפילה, ה”נ כאן הכל יודעים שדעתו ודאי להשהותה ע”ג האש עד זמן סעודתו וכשם שאם ידע מראש שתכבה האש דעתו להעביר את הקדירה לאש אחרת, ה”ה אף בלא ידע שתכבה האש מ”מ כיון דבשעה שמעמידים את הקדירה על האש הלא ודאי רוצים להשהותה עד זמן סעודה ולכן הוה כמו שדעתו לכך ולא דמי לספיקו של הגרע”א. וכיון שלא עשה שום מעשה שנראה כהסיח דעתו מלהחזיר. ודוקא אם העמיד הקדירה בידים ע”ג קרקע ועשה מעשה שנראה כאילו הסיח דעתו מלהחזירו אבל לא כשנפלה מאליה וה”נ בכבתה. וע”ע מ”ב סי’ ח ס”ק מד)) .

However, some Poskim hold that only if the blech/hotplate is still hot enough to warm up cold food (i.e., one noticed soon after it went off), may one transfer the food to another covered flame ((משום דבכה”ג לא בטלה שהייה הראשונה, אג”מ ח”ד סי’ עד אות לח, כמו שעומדת על בלעך במקום רחוק קצת מהאש שמותר להעמידה במקום יותר חם, ודוקא כשנכבה מאליו. כך אמר לי הגר”ע אויערבאך שליט”א בשם חמיו הגרי”ש אלישיב שליט”א, וכ”כ שו”ת בצל החכמה ח”ד סי’ קלז אם לא בעת הצורך. ויש פוסקים שמחמירים לגמרי בזה ואין נפק”מ אם הכירה עדיין חם או לא: הגר”נ קרליץ שליט”א הובא באוצרות שבת עמ’ תט, הגר”ח קניבסקי שליט”א שם, וילק”י כרך א עמ’ קה מחמיר לכתחילה בזה ומיקל אם נותן על פלטת שבת, ואור לציון פי”ז ס”ק ז ג”כ מחמיר בזה לבני אשכנז לגמרי משום אינו “עודה בידו” וגם לא היה בדעתו שהאש תכבה. אבל לבני ספרד מיקל אם המאכל עדיין יס”ב)) .

Q. What if one realized on Shabbos that the hotplate was not switched on before Shabbos, may the food on it be transferred to a covered flame/hotplate?

A. There is an opinion that holds that as long as the food is still warm, it may be transferred to another source of heat on Shabbos ((שו”ת מנחת שלמה ח”ב סי’ לד אות יז, ואין זה כהניח ע”ג קרקע משום שכל העסק הוא רק להעמיד על האש וכל הטיפולים הם הכנה ולא סילוק ויש לראות אם העמדה בטעות על הפח כמעמיד על האש ועדיף טפי מכסא וספסל. וכ”כ שש”כ פ”א הע’ סט [סעי’ כח)) . This is because it was originally intended to keep it on the fire until it was needed.

Other Poskim, however, do not allow it to be transferred to another hotplate/blech on Shabbos ((הגרי”ש אלישיב שליט”א הובא בס’ שבת בשבת עמ’ רלד ס”ל שלא איכפת לן אם יש לו דעת להחזיר, והגרש”ז חידש דדעתו להחזיר אינו דין במעשה הסילוק, אלא במשך השהייה בכל השבת)) , since, when Shabbos began it was not on a flame, it is as if it was placed on the ground. When it is being placed onto a blech on Shabbos, it is as if it is being put there for the first time which is forbidden [see page 36].

Q. What if the fire/hotplate switched off by itself and later went back on?

A. All opinions agree that the food is permitted ((אפי’ לדעת הגרי”ש אלישיב שליט”א שמחמיר בשאלה הקודמת מודה הכא שמותר כיון שאין שום מעשה בקדירה. כ”כ בקונטרס מים חיים (להגרי”א דינר שליט”א)) .

Q. If an urn goes on and off automatically to keep the water warm all Shabbos, is the water considered as if it is “off the fire” when the urn is switched off ((ונפק”מ בזה שאסור לערות אז לתוך קדירה אחר שעל האש כיון שהוא כאילו אינו עודו בידו, ואסור משום חזרה)) ?

A. No. Since the urn is made to go on and off, it is not considered as if the water is off the fire even when the urn is off ((לענ”ד, ופשוט הוא. ואח”כ הסכים עמי הגרפ”א פאלק שליט”א והגר”ע אויערבאך שליט”א.)) .

Tilting a Pot

 

Q. If one tilted a pot sitting on an uncovered flame (i.e., no blech), may one replace it back on the flame or is it considered chazara to an open flame which is forbidden?

A. Chazara means to remove a pot from the fire. Once a pot has been removed, various conditions need to be met (e.g., blech, intention etc.) to permit returning the pot in a way that it shouldn’t look like he is cooking on Shabbos. However, if the pot was never actually “removed”, returning it is not called chazara, and it is as if it stayed on the fire the entire time.

Some Poskim are of the opinion that in the above case, where the pot was simply tilted but not actually removed (and remained in a place that would keep the food yad soledes bo), it is not considered a “removal” of the pot and it may be tilted back into its original position on Shabbos even if there was no blech on the fire ((הגרמ”מ קארפ שליט”א בס’ שבת בשבת עמ’ רכא עפ”י גמ’ לז. “אם עקר לא יחזיר” – וכ”ז שלא הגביה מן הכירה אין ע”ז שם עקירה, וכ”ה בלשון הרמב”ם פ”ז ה”י “כשנוטלם”. ושמעתי מהגרפ”א פאלק שליט”א שאפי’ אם הגביהו הקדירה קצת מהכירה למקום שהתבשיל יכול להשאר לחום של יס”ב (דהיינו לא הגביהו הרבה), אפשר שמותר להחזירה לאותו כירה אפי’ שאינו גו”ק שלא נקרא ע”ז שם חזרה בגלל שלא נחשב כסילוק מהאש, רק המשך לשהייה הראשונה)) .

Returning to an Oven

Returning a pot is not only permitted to the place that it was taken from, it may also be returned to any other blech/hotplate, as long as all the conditions stated above are fulfilled. This is true even if the new place it is being returned to is hotter than the original source of heat ((כ”כ הרמ”א סי’ רנג ס”ב, מג”א ס”ק כג בשם הרמב”ם פ”ג הל’ יא, מ”ב שם ס”ק סב בשם המג”א והרמב”ם)) .

Returning food to an oven is an exception to the above mentioned halacha.

Although, under certain conditions, food may be left in an oven from before Shabbos (see הלכות שהייה – page 26), according to most Poskim, it is forbidden to return food to an oven on Shabbos, even if all the other conditions were met, i.e., intention, still in ones hand, etc ((גמ’ שבת לז. “לא שנו אלא על גבה, אבל לתוכה אסור, וכתבו שם הראשונים דטעמא דאסור משום דמיחזי כמבשל בשבת, כ”כ הרשב”א והר”ן בשם הרא”ה והשו”ע שם, מחצה”ש ס”ק לח, מ”ב ס”ק נח)) .

Q. Why?

A. There are various reasons given:

a)    An oven has the status of an uncovered flame, and as explained earlier, food may not be returned to an uncovered flame on Shabbos ((שו”ת מנחת יצחק ח”ג סי’ כח.)) .

b)    Chazal only allowed returning to “on top” of a source of heat and not to “inside”, since when placing food inside there is a higher degree of “looking like cooking” ((שם. וגם משום שבתוכו יש הרבה הבל, כ”כ ברמב”ן שבת לו ורש”י ור”ן דף לז. שם. וכ”כ בס’ חידושי בתרא עמ’ פח בשם הגרח”פ שיינברג שליט”א. וע”ע בחזו”א סי’ לז ס”ק ט, שו”ת מנחת יצחק ח”ג סי’ כח, זו”ש עמ’ 45, שש”כ פ”א סי”ז [יט], הגרי”ש אלישיב שליט”א הובא בשבות יצחק עמ’ פט. וכ”כ הגר”ח קניבסקי שליט”א הובא בס’ עם מקדשי שביעי)) .

  • There are some opinions that allow returning to our ovens on Shabbos since only in the days of Chazal placing food into an oven appeared like cooking [see footnote for more details] ((ערוה”ש סי’ רנג ס”ק יז, שו”ת שבט הלוי ח”ג סי’ מח עפ”י שלטי גיבורים הובא במג”א משום דשאני כירות שלהם שהיה בהם ב’ אפשרויות, גב שרחוק מן האש ישלוט בה אוירא ותוך שעיקור גחלים בתוכה, וכיון שנותן בתוכה ולא ע”ג נראה כמבשל, אך כירות שלנו שיש להם רק תוך וגם שהחום שווה בכל מקום וכל פעם מבשל רק במקום הזה בכה”ג לא גזרו על תוך [ולפ”ז אם הוא גו”ק מותר להחזיר לתוכו] לא מיחזי כמבשל. וכ”כ להקל בשו”ת אבן ישראל והגר”א קוטלר זצ”ל הובא בקיצור הל’ שבת (להגר”ש איידר זצ”ל) הע’ תתקסג. וס’ חידושי בתרא עמ’ פח הובא טעם של הגרא”ק זצ”ל להקל, והוא הרשב”א והר”ן שכתב “כדרך שמבשלין בה תמיד” אז נראה כמבשל, אבל בתנורים שלנו הדרך לאפות ולצלות בתנור ולא לבשל. וכ”כ להקל הילק”י כרך א עמ’ קב אם מקיימים כל דיני חזרה)) .                                             Nevertheless, most opinions do not differentiate and hold that it is forbidden ((אג”מ או”ח ח”ד סי’ עד אות כו, שו”ת מנחת יצחק ח”ג סי’ כח, וכן דעת הגרי”ש אלישיב שליט”א הובא בס’ שבת בשבת עמ’ רלז. ואין לסמוך על טוח בטיט להתיר חזרה כגון ע”י להדביק הכפתורים, שרק משום שהייה מועיל ולא בחזרה. והטעם, משום מיחזי כבישול לא מהני טוח בטיט משום טוח בטיט רק מהני שלא יבאו לחתות, לכן אין לסומך ע”ז לחזרה)) .

Q. Is it possible to make a blech in an oven e.g., by using an oven insert (a metal box that fits into the oven and food is placed inside it)?

A. According to some opinions, an oven insert is sufficient and therefore food  can be returned to the oven on Shabbos (providing the other four conditions  are present) ((אג”מ ח”ד סי’ עד אות כז.)) . Other Poskim, however, do not rely on this ((ס” שבות יצחק עמ’ צ’ עפ”י החזו”א שכיון שכל האויר חם אין הפסק בין קרקעיתו לקדירה מתיר כלום)) .

Q. What if the oven is currently off and the temperature inside the oven is under yad soledes bo; may food be returned to it?

A. Yes (( מ”ב ס”ק צב, כיון שאין עליו שם תנור כלל. אך לפי הגר”ז בקו”א ס”ק ה אסור ע”ש טעם. וכן אמר לי הגר”ע אויערבאך שליט”א.))

Q. What if one partially slid out a tray in the oven to take some food from the tray; may one slide the tray back into the oven?

A. If the food was moved to a place where the heat of the oven would not enable the food to remain at a temperature of yad soledes bo, it may not be pushed back into the oven as this constitutes “returning”.                                  However, if the tray was slid out from the oven just a small amount, but remained in a place where it could keep the food at yad soledes bo, the tray may be pushed back into the oven ((כך שמעתי מהגר”ע אויערבאך שליט”א והגרפ”א פאלק שליט”א.)) .

Q. May food be warmed up on an open oven door, i.e., one opens the door of the oven [in a permitted manner – see page 28] and places the pot on the door?

A. Yes ((רמ”א סי’ רנג ס”ב. וכן שמעתי מהגר”ע אויערבאך שליט”א)) . Provided the food is dry.

Q. Is it permitted to return foods to a hot-cupboard?

A. Yes. This is because a hot-cupboard is never used for cooking.

Moving Pots From Place to Place on a Blech

A flame provides heat to the area above it and to a certain extent also to the area around it. The Poskim discuss what status does the area around the flame have: does it have the same status as above the flame, or since it is slightly removed from it, it is as if it is off the flame?

This question is relevant to a common scenario, if a pot was on the blech but was not directly above the flame, can it be moved to a position on the blech directly above the flame, or is it considered first placement of the food on the flame which is forbidden on Shabbos?

In addition, the above question is of relevance to many of the halachos pertaining to bishul. For example, according to many Poskim:

  • Many are meticulous not to mix or even remove food from a pot whilst it is still directly on the flame ((גמ’ שבת יח: “שמא מגיס בה” ועי’ רש”י שם שכתב מגיס מהפך ומבושל הוי בישול. וכ”ה ברמב”ם פ”ט ה”ג וז”ל שם “שכל העושה דבר מצרכי הבישול הרי זה מבשל”. ומשמע להדיא מראשונים דאסור להגיס בקדירה אפי’ אם התבשיל כבר מבושל כ”צ וז”ל הכל בו “מגיס חייב משום מבשל אפי’ בקדירה מבושלת כ”ז שהיא על האש” וכ”ה בארחות חיים ומג”א סי’ שיח ס”ק מב ותו”ש ס”ק נו. ועי’ ברמב”ם פ”ג הי”א שכתב “והיא על האש”. וכ”כ רש”י שבת יח:, רוקח סי’ כו. ועי’ במ”ב ס”ק קיז “והרוצה להחמיר יחמיר בהגסה ממש”. וכמה פוסקים מיקלים במקום הצורך להוציא מאכל מהקדירה אפי’ כשהוא על האש, חזו”א סי’ לז אות טו, שו”ת שבט הלוי ח”י סי’ יא, שו”ת באר משה)) ,
  • One may not add hot water to food that is drying out if the pot is directly over the flame ((גמ’ ביצה לד., רשב”א על שבת יח:, כל בו סי’ לא, ב”י סי’ רנג. וכן משמע מאג”מ או”ח ח”ד סי’ עד אות יד דנתינת מים לתבשיל על האש הוי חשש הגסה וכ”ה בשו”ת אז נדברו ח”ו סי’ נו אות ב שהמחמיר בזה יתברך ממקור הברכה משום דהוי הגסה. ויש מקילים בזה עי’ בס’ מאור השבת ח”ב עמ’ שכז שהביא מכתב מהגרי”י פישר זצ”ל ויבלח”ט הגר”ח קניבסקי שליט”א חושש משום הגסה ע”ש טעמו משום שהשו”ע לא הביא חומרא זו ואין מסתבר להחמיר בדיני מגיס במה שלא הובא בשו”ע)) ,
  • One may not return the lid of a pot if it is directly over the flame ((אפי’ אם התבשיל מבושל כ”צ. מקור חיים, תהל”ד, שבה”ש ס”ק פא, אג”מ סי’ עד אות י. אבל הרבה פוסקים מיקילים בזה, הגרש”ז זצ”ל הובא במאור השבת מכתב יט, הגרי”ש אלישיב שם, שו”ת צי”א ח”ז סי’ טו, שו”ת אז נדברו ח”ה סי’ יג-א, שו”ת באר משה ח”ו סי’ קטו, שו”ת תשובות והנהגות ח”א סי’ רז)) .

However, in all of these cases, if the pot is not directly over the flame, it may be permitted. Thus, it is important to know exactly what is considered “directly on the flame” and what is not.

A Blech

There are 3 different areas on a blech [for hotplates – see page 42]:

[1] = Directly over the flame.

[2] = Not directly over the flame, but in an area that keeps food yad soledes bo.

[3] = In an area that is not yad soledes bo.

Area [1]

A pot anywhere in this area of the blech is considered “on the fire”:

  • Food may never be placed in this area for the first time on Shabbos, even   if it is a hot solid food.

Area [2]

A pot in this area of the blech is also considered “on the fire” since it can heat up the food to yad soledes bo[approx. 45°c] ((משמע ממ”ב ס”ק סז ע”ש היטב.)) :

  • A dry fully cooked food may not be placed in this area of the blech for the first time.
  • One may not place cold liquid to heat up in this part of the blech even for    a moment, since it can reach the temperature of yad soledes bo which is forbidden on Shabbos due to the prohibition of bishul ((שו”ע סי’ שיח סעי’ יז)) .
  • cording to most Poskim, a pot on section [2] may be moved to section   [1] on Shabbos ((וכ”ז אף למחמירים ש”בלעך” לא נחשב לגו”ק, )ובלבד שלא יגביה הקדירה ויעקרנה כולו מהכירה( וכיון שאין כאן סילוק, זה לא נחשב כחזרה, רק כהמשך השהייה)) . Since it was on a place that could heat up the food to   yad soledes bo, it is as if it were on the flame ((מ”ב ס”ק סז, וכ”כ החזו”א בדעת המ”ב)) . Thus, the pot may be moved and placed directly over the flame on Shabbos ((אג”מ ח”ד סי’ סא, הגרי”ש אלישיב שליט”א, הגר”י ראטה שליט”א והאדמו”ר מקלויזענבורג שליט”א הובא בשבת במטבח, זו”ש עמ’ 47. הגרש”ז זצ”ל במנחת שלמה ח”ב סי’ לד ס”ק יב כיון שהמקום הוא כזה שמעמידים שם בכוונה לשמור על החום אין זה חשוב כסילוק מהאש והיסח הדעת)) . (providing the food is fully cooked.)
  • According to these Poskim, when wanting to remove the food (and lid acc. to some Poskim) from a pot that is on the flame, one could move the pot to section [2], since regarding these halachos it is considered as off the flame ((אג”מ או”ח ח”ד סי’ עד ס”ק יא, “ואם מקצת על האש ואף בסמוך ממש להאש יש להחמיר”. הגרי”ש אלישיב שליט”א הובא בס’ שבות יצחק עמ’ קצט שבכה”ג לא חשיב שעומדת על האש לענין חומרת הכלבו, ואעפ”כ חשובה כעל האש לענין חזרה)) , and can then move it back over the flame since that whole area – according to these Poskim – is considered as if it was never removed from the fire regarding the halachos of returning food.

This applies even if he let go of the pot, and did not have intention when    removing it to area [2] to replace it in area [1].

However, there is an opinion that holds that even if the pot is in section [2], it may not be moved directly over the flame ((הגר”נ קרליץ שליט”א הובא בארחות שבת עמ’ קב)) . This is because it is in an area that is not the normal place to cook, and therefore placing it directly over the flame is considered first placement on Shabbos and is forbidden.

Area [3]

 

A pot that is in area [3], i.e., an area that could not heat up food to yad soledes bo, is considered “off the fire” ((מ”ב ס”ק סז, וכ”כ החזו”א בדעת המ”ב.)) and has the same status as on the counter top ((אג”מ ח”ד סי’ סא ד”ה אם נטלו, זו”ש עמ’ 47, הגר”י ראטה שליט”א הובא בשבת במטבח עמ’ 44)) . Thus:

  • A pot on area [3] may not be moved to any other part of the blech on Shabbos (i.e., even to area [2]), even if it was on the latter areas on Shabbos ((שהרי זה שהייה בתחילה בשבת דאסור, כ”כ החזו”א סי’ לז ס”ק י ד”ה ס”ד.)) .
  • A pot that is in area [1] or [2] should not be moved to area [3] even if one has intention to return it to the area it was taken from (unless it was held onto throughout). ((אג”מ או”ח ח”ד סי’ סא. וז”ל שם “אם הניח על הפח במקום שאין יס”ב נחשב כהיסח הדעת ואסור להחזירה דהוי כהניחה ע”ג קרקע דאפי’ דעתו להחזיר אסור”. וכ”כ הגר”י ראטה שליט”א הובא בקובץ בית תלמוד להוראה ח”ג דף קנה. וכן אמר לי הגר”ע אויערבאך שליט”א))
    • For example, if a pot is in area [1], and one wishes to remove it from the flame in order to take some food from it or to add water, one should take care to remove it ((אפי’ אם המאכל מתבשל כ”צ. רא”ש פ’ כירה סי’ יא, ועי’ רמ”א סי’ שיח סי”ח, ומ”ב שם.)) only to area [2] (where food may be removed/water added), but not to area [3] unless one holds it the entire time.
  • There is an opinion that holds that if the pot was in area [1] or [2] at any time, and was moved to area [3], it may be returned to areas [1] or [2] provided it is fully cooked (with the exception of a liquid that cooled under yad soledes bo). This is because placing it in this area shows that he is not finished with it being on the fire and is compared to holding it in ones hand the entire time ((כך אמר לי הגרפ”א פאלק שליט”א)) .
  • Fully cooked food may be placed in this area of the blech for the first time on Shabbos. This is because leaving it there will not cause it to heat up to yad soledes bo (( אג”מ ח”ד סי’ עד אות לב, וכתב עוד שם “שבבתי מלון (האטעלן) אין להתיר כלל אפילו לאנשים הכשרים”.)) .

However, some Poskim disagree and hold that unless all the conditions of chazara are present, food should not be placed in this area of the blech on Shabbos even if it cannot reach the temperature of yad soledes bo ((חזו”א סי’ לז ס”ק ח ד”ה והנה, “שאין למסור לכל א’ תורתו ואין כאן מחיצה המגדרת בין מקום האסור למקום המותר וכו'” אבל אם נהגו להחזיר למקום שאין יס”ב אין כח למחות. וכן פסק הגרי”ש אלישיב שליט”א הובא בשבות יצחק עמ’ עג שהכל נחשב ככירה א’. וכתב שם עוד בשם הגאון הנ”ל שאין כונת החזו”א לאיסור כללי שלא למסור לכל א’ תורתו בידו אלא הוא מעצם גזירת חזרה שלא חילקו בין מקום למקום באותו תנור שלא למסור לכל א’ תורתו בידו)) .

Q. If water is in area [2], may it be moved to area [1] if it will start bubbling?

A. If it had fully boiled before Shabbos and was moved from the direct flame to prevent it from evaporating, it may be moved back over the fire on Shabbos ((שו”ת נשמת שבת ח”ד סי’ א להגרי”ד הארפענעס שליט”א מח”ס ישראל והזמנים ושו”ת ויברך דוד ועוד. וכתב שם עוד ולמיגדר מילתא יש להחמיר, ואם לא העלו רתיחה ערב שבת אסור לעשות כן משום תהל”ד יז מספק”ל במים שכל זמן שלא נתבשלו ע”ש כדי שיעלו רתיחות חשוב בלא בישול לגמרי ומעלה רתיחה בשבת הוי ליה בישול וכ”כ בשו”ת מנחת יצחק ח”י סי’ כח בשם אגל”ט וכ”כ שו”ת אז נדברו ח”ו סי’ כ)) .

Q. What if there was not enough place on the blech, and one put the pot half on the blech (the yad soledes part) and half hanging over the side before Shabbos, may one move the pot to be fully on the blech on Shabbos?

A. Yes, provided it was on a place that keeps the food hot (yad soledes bo) ((שו”ת יבקש תורה ח”ה סי’ ה)) .

Some Poskim suggest that if one places the pot fully on the hot part of the blech before Shabbos, even for a moment, and then moves it half off the blech, then on Shabbos it may be moved back fully onto the blech ((כך שמעתי מהגרפ”א פאלק שליט”א)) .

Summary

There are three areas on a blech: [1] – directly over the flame, [2] – yad soledes bo area, and, [3] – non yad soledes bo area.

v   If the pot is in area [1] or [2], it can be moved around anywhere in that area, e.g., from area [2] to [1].

v   If the pot is in area [3], it may not be moved to areas [1] or [2]. Some Poskim allow it to be moved from [3] to [2] or [1] if it was in the latter areas sometime on Shabbos.

Hot Plate

Q. Do the above halachos apply to food on an electric hot plate?

A. No. The entire hot-plate is considered “on the flame” and food that is fully cooked may be moved from one place to another on Shabbos ((כיון שגופי החימום עוברים כמעט בכל אורכו, ואם המציאות היא אחרת, יש לעיין)) . [Unless the edges of the hot-plate are actually under yad soledes bo.]

Q. If one has a pot resting on top of another pot from before Shabbos (e.g., there was not enough space on the blech/hotplate), after removing the lower pot, may the top pot be placed directly on the blech?

A. No. Since it was never on the actual blech, placing it there is equivalent to placing food on a blech for the first time which is forbidden [see above “placing for the first time” page 35 ((חזו”א סי’ לז ס”ק יא, זו”ש עמ’ 43, ארחות שבת עמ’ צ. ועי’ אור לציון פ”ל אות ט שמיקל בזה, כי דנים כאילו גם הסיר העליון הוה ע”ג האש, ומסיים שם “והמיקל בזה יש לו על מה לסמוך)) ].

Nevertheless, if the pot was placed on the blech/hot-plate before Shabbos and then on top of another pot, it may be lowered and placed on the blech itself anytime during Shabbos (as long as it is still hot) ((שמעתי מהגרפ”א פאלק שליט”א. וכ”כ באור לציון פ”ל אות ט. אבל הגר”ע אויערבאך שליט”א אמר לי שלא מועיל כלום)) .

This is because placing a pot on top of another pot shows that one isn’t finished with this pot being on the fire. It is compared to holding it in one’s hand the entire time, thus permitting one to return it at any time he wishes.

Moving from Blech to Blech

Q. May one move a pot from one blech to another?

A. Yes. It may be moved even from a blech to a hotplate or vice versa. This is true even if it is being moved to a higher flame than where it came from ((רמב”ם פ”ג הי”א “אפי’ לכירה שהבלה מרובה, אבל לא מכירה להטמנה”, וכ”ה ברמ”א סי’ רנג ס”ב, מג”א שם, מ”ב ס”ק סב)) . Nevertheless, all five conditions must be fulfilled (has a blech, still holding onto it, still hot, fully cooked, intention).

פינה ממיחם למיחם – Transferring from Pot to Pot

Just like a pot can be moved from one blech to another (if all the conditions are fulfilled), so too one may transfer food from one pot to another that is on the blech. This is included in חזרה.

This is permitted if all the requirements of chazara are fulfilled. The food should, however, not be transferred to the second pot while it is directly over the fire ((משום חשש הגסה, עי’ סו”ס שיח בב”י ומ”ב שם)) . If the second pot is in area [1] on the blech, it should be moved to area [2] (see above, page 63), filled, and moved back to area [1]. It does not need to be held onto throughout.

Q. If food was removed from the blech and placed into an empty pot (that was never on the blech), may the second pot be placed on the blech?

A. Yes ((שעה”צ ס”ק מז. ומקור לדין זה הוא גמ’ שבת לח: “בעי ר’ אשי פינה ממיחם למיחם מהו והוא בעא דלא איפשטא. ועי’ תוס’ שם שמפרש דמיירי שפינה ממיחם א’ למיחם ב’ ורוצה ליתן המיחם ב’ על האש וכ”כ הר”ן והמג”א ס”ק כ פסק להחמיר בזה ואסור אבל השעה”צ שם מיקל בזה. והגר”ש אויערבאך שליט”א [בהסכמתו לס’ משאת בנימין] תמה ע”ז היאך המ”ב מיקל כ”כ כנגד המג”א, הלא ההיתר משום תירוץ שני בר”ן אבל לשון הר”ן מוכח שהעיקר כתירוץ א’, וע”ש עוד ראיות, אבל להתיר בפשיטות כאילו אין מקום להחמיר הוא תמוה? והניח בצ”ע אבל למעשה מיקל כמש”כ המ”ב. [הובא בס’ שבת במטבח עמ’ 67]. ואפשר שלפי בני ספרד זה אסור כיון שכבר מונח התבשיל בכלי שני נקרא צונן ואסור משום בישול, עי’ סי’ שיח סט”ו, ובה”ל שם ד”ה אם נצטנן. אבל בשו”ת אור לציון כתב שאם לערות את התבשיל לכלי אחר מותר להוסיף מים אף מכלי שני. וע”ע בס’ שבת בשבת עמ’ רמ שכתב שלכתחילה ראוי להחמיר בזה (שלא להעבירו למיחם אחר) כיון שהרבה מגדולי האחרונים מחמירים: המג”א, הגר”ז, תוס’ שבת, הגר”א, ורק בדיעבד יש לסמוך להקל)) .

  • Accordingly, some Poskim hold that one may only heat up (dry) food on Shabbos on top of a container of food that is on the blech [see page 38]. Consequently, if one wishes to heat up food on Shabbos (that is fully cooked and dry), and has no food currently on the blech, he may fill an empty pot with water from the urn/kettle and place it on the blech, now allowing him to place the cold food on top of that pot to heat up. (As mentioned earlier, many Poskim allow one to re-heat a dry, fully-cooked food on top of an empty container that is on the blech – see page 38.)

Q. May one use a utensil to transfer food from one pot on the fire to another, e.g., when adding hot water from an urn to a cholent, can the water be put in a cup first?

A. According to many Poskim, one may ((והמקור לדין זה הוא תוס’ ריש פרק במה טומנים, ועי’ מאירי שם. וכ”כ להקל הגרש”ז זצ”ל בשש”כ פ”א הע’ מד [מט], שש”כ פ”א סעי’ טז (שכתב בתחלה שאפשר שיש להחמיר כיון דבפינה ממיחם למיחם פסק המג”א להחמיר ורק המ”ב מיקל אין להוסיף על דבריו ולא שרי אלא ליתן מהמיחם שעמד ע”ג האש לתוך קדירה שמעמידה ע”ג האש אבל אם עירה באמצעות כלי לתוך הקדירה אפשר דחשיב כהניח ע”ג קרקע ואסור אך שוב אמר שמותר שלא מסתבר לאסור להעמיד את המים בלבד ע”י עירוי לתוך קדירה שעל האש), וכ”כ להקל בעל קהלות יעקב זצ”ל הובא בשבת במטבח עמ’ 68, הגרי”י פישר זצ”ל, הגר”ש איוערבאך שליט”א הובא בארחות שבת. והסברות להקל בזה, הנה דעת הגרי”י פישר זצ”ל שכיון שזה שהייה חדשה דהוה כהניחה ע”ג קרקע, ולדעתו אין להחמיר אפי’ ע”ג קרקע אם דעתו לחזור, וה”נ הכא מותר (הובא במאור השבת ח”ב עמ’ שיח).  וע”ע בארחות שבת עמ’ צז שהביא מהגר”ש אויערבאך שליט”א שכתב שכיון שאין כוונתו להחליף את הכלים אלא כל כוונתו להעביר את המים אל הקדירה ורק לצורך זה הוא מעבירם אל הכוס, ואינו דומה לציור בגמ’ שכוונתו להחליף את הכלים)) . However, many Poskim are stringent (unless there is no other solution) ((והצד האיסור בזה מבואר בר”ן שנחשב כהניחו ע”ג קרקע הואיל ישהה במיחם שלא עמד על האש ולא עתיד לעמיד על האש. וכ”כ הגרי”ש אלישיב שליט”א הובא בשבות יצחק עמ’ רד שלכתחילה עדיף אם אין חשש בליעות בב”ח במיחם ואז מותר בכ”ש, אבל מעיקר הדין הגאון הנ”ל מיקל שהכא קיל טפי מגמ’ שם שהרי לעולם אין כאן “פינה” ממיחם, דהמיחם הא’ לא נטלו מן האש כלל, רק שפך ממנו לכלי אחר ודינו כמו הכלי הא’ כשנסתלק מן האש, כ”כ בס’ שב”ש עמ’ רמ. (וע”ע לקמן עוד חששות בענין זה(. וכ”כ להחמיר שו”ת שבט הלוי ח”ג סי’ צג, וכ”כ שו”ת אז נדברו ח”ו סי’ נו ס”ק ב שחושש לשעה”צ שיח ס”ד ד”ה אם נצטנן שאף שיש לדחות דקאי שם על שיטת השו”ע, מ”מ יש להחמיר בזה היכא דאפשר, תשובות והנהגות ח”ב סי’ קעג “אף שהמ”ב מיקל מהיות טוב עדיף לצאת לכו”ע” וע”ש עוד טעם להחמיר. וגם לפי הספרדים לכאורה זה אסור)) . One who follows the lenient view should not place the cup down at any time ((כנלענ”ד, ואח”כ שמעתי מהגרפ”א פאלק שליט”א.)) .

v       Sefardim may not use a cup to transfer water from the urn to the second pot ((עי’ בה”ל סי’ד שיח ס”ד ד”ה אם נצטנן שהביא בשם הפרמ”ג דכלי שני הוי כנצטנן, לכן אסור לערות ממנו לתוך כלי ראשון וזה קאי על שיטת המחבר אבל לפי הרמ”א כ”ז שלא נצטנן לגמרי מותר)) .

Adding Water to Cholent

Adding water to a cholent (or any other food) that is drying out on Shabbos may involve six halachic issues:

  1. חשש בישול
  2. חשש בישול אחר צלי
  3. חשש של חזרה
  4. חשש מגיס
  5. חשש בשר בחלב
  6. חשש הטמנה

Note: If the cholent is not fully cooked, it is always forbidden to add water to it.

1. חשש בישול

Adding Water

  • According to Ashkenazim, as long as the water one is adding is at least warm enough to be enjoyed as a warm drink, it may be poured into the cholent (provided it was once fully boiled ((סי’ שיח סעיף ט”ו.)) and all of the other conditions of chazara are met). If the water is below this level of heat, it may not be poured into the cholent.
  • According to Sefardim, the water must be yad soledes bo in order to be poured into the cholent ((עי’ ב”י סי’ רנג ס”ד שהביא הנמ”י מר’ יונה “שטומנין קומקום של מים מחים ליתן לתוך הקדירה בשבת כשהתבשיל מצטמק ופעמים הא’ אין יס”ב והא’ יס”ב ומבשל זע”ז אע”פ שהו רותחין אם פסקה כח רתיחתן יש בהם משום בישול”.)) . Liquid under the temperature of yad soledes bo may not be poured into the cholent on Shabbos ((סי’ שיח סעיף ט”ו.)) . Using a cup to transfer water from the urn into the cholent pot is forbidden according tos’fardim ((עי’ בה”ל סי’ד שיח ס”ד ד”ה אם נצטנן שהביא בשם הפרמ”ג דכלי שני הוי כנצטנן לכן אסור לערות תוך כלי ראשון וזה קאי לשיטת המחבר, אבל לפי הרמ”א כ”ז שלא נצטנן לגמרי מותר. ושו”ת אור לציון ח”ב פי”ז אות ח כתב וז”ל שאין לערות מים חמים ואפי’ מכלי ראשון לתוך סיר החמין שהצטמק אע”פ שהסירו מן האש (כיון שהמים שמערה אותם יש להם דין עירוי והמים שבתבשיל דינם ככלי ראשון ממש), ויש מקילים בזה ויש להם על מה לסמוך. ואם העביר את התבשיל לאחר שהסירו מן האש לכלי אחר, מותר לערות עליו מים חמים אף מכלי שני.))
    .

Closing the Lid

Additionally – according to all opinions – one may not close the lid of a pot if the food is not fully cooked. If the lid was removed from a pot, and one discovered that the food inside is not fully cooked, the lid may not be replaced under any circumstances ((עי’ סי’ רנד ס”ב, רנז ס”ד, ובה”ל שם.)) .

2. חשש בישול אחר צלי

 

After a solid has been fully cooked, it may be re-heated. However, this is only if the second cooking is done in the same manner as the first ((ועיקר דינים אלו מבוארים בסי’ שיח ס”ה.)) . The same applies to other forms of cooking e.g., roasting, baking etc. i.e., one may roast/bake something that was previously roasted/baked.

However, one may not interchange processing methods. E.g., one may not    cook something that was previously roasted or roast/bake something that was previously cooked.

For example:

  • Noodles that were boiled in water may be placed into hot chicken soup after it has been removed from the flame.
  • Schnitzel that was baked in an oven may be heated up by placing it on a pot on the blech.
  • Bread/matza may not be placed into a hot pot of soup – even after it has been removed from the flame, since that constitutes cooking a baked item.

[If one uses a ladle to serve the soup, one may be lenient and consider the soup bowl to be a kli shelishi and bread may be added ((מ”ב סי’ שיח ס”ק מה. ואין זה סותר מש”כ המ”ב בס”ק פז שכלי ששואב מכ”ר י”א דדינו ככ”ר משום שבס”ק מה שמיקל רק בפת משום שפת הוא רק חומרא, שדינו כקלי בישול לכן סומך להקל על המצקת שדינו ככ”ש)) .]

Therefore, if a cholent has dried up and is now considered a roasted food, then,  by adding water to it, he is now cooking a baked item – which is forbidden.

Although there are Poskim that may forbid adding water to the cholent for the above reason ((בה”ל שם)) , many Poskim are lenient since it is considered cooking after baking after cooking. i.e., the cholent was originally cooked and then after it dried up it is considered roasted, and adding the water is cooking again. Most Poskim permit this ((שביתת השבת ס”ק צ, אגל”ט ס”ק ט, קצוה”ש סי’ קכד ס”ק נד, אג”מ ח”ד סי’ עד אות יג, הגרי”ש אלישיב שליט”א, שו”ת באר משה ח”ג סי’ נ, שו”ת מנחת יצחק ח”ו סי’ כ, הגרפ”א פאלק בזו”ש, דברי יציב הובא בס’ פני שבת. ואע”פ שהבה”ל משמע להחמיר בזה, אני כתבתי כפי הפסק של רוב הפוסקים שחולק ע”ז ותמה למה הבה”ל מחמיר בזה)) .

To satisfy all opinions, it is best that one checks the cholent periodically, to ensure that there is still liquid inside, and, if there is, then – according to all opinions – water may be added ((שו”ת תשובות והנהגות ח”ב סי’ קעג, שו”ת נשמת שבת ח”ד סי’ ג. וע”ש שהביא משו”ת לבושי מרדכי סי’ טו אות ב’ שאם התבשיל מצומק עד שאינו ראוי לאכילה ע”י קשיותו אז בנתינת המים יש משום בישול מן התורה כמש”כ הרמ”א ס”ד והוא (נשמת שבת) הניח שם בצ”ע כי לא מצינו בישול בכה”ג אלא מה שלא נתבשל לעולם משא”כ הכא)) .

3. חשש חזרה

If one is pouring water directly from an urn/kettle into the cholent, there is no problem of chazara. However, water that was not on the fire may not be used. For example, water may not be taken from a flask/thermos (that is not connected to any source of heat/electricity) as this is considered first placement on Shabbos ((חזו”א סי’ לז ס”ק י ד”ה ס”ד, הגרי”י פישר זצ”ל והגרש”ז זצ”ל הובא במאור השבת ח”ב עמ’ שכג וז”ל שם ואף שנתן המים מער”ש לטרמוס על דעת שכשיתאדו המים שבטשאלנט יוסף ממנו מים ומ”מ אסור כיון שאינו בידו)) .

 

Using a cup to transfer the water from the urn into the cholent is subject to a dispute. See above page 69.

  1. 4. חשש מגיס

There is an opinion that holds that adding water to a food on the fire/blech is a problem of מגיס – stirring, which occurs as a result of pouring water into it, and applies even if the food is fully cooked ((ועי’ גמ’ ביצה לד., חי’ הרשב”א שבת יח:, ושלטי גיבורים שם. וכן משמע מאג”מ או”ח ח”ד סי’ עד אות יד דנתינת מים לתבשיל על האש הוי חשש הגסה וכ”ה בשו”ת אז נדברו ח”ו סי’ נו אות ב שהמחמיר בזה יתברך ממקור הברכה משום דהוי כהגסה. ויש מקילים בזה עי’ בס’ מאור השבת ח”ב עמ’ שכז שהביא מכתב מהגרי”י פישר זצ”ל)) . This is a problem because it distributes the taste of the food evenly which is an improvement similar to baking a cooked food, or because we are concerned that there may be small parts of the food that the fire didn’t reach properly, and by mixing the food, these particles will become cooked on Shabbos ((מרכבת המשנה ג יא, ב”י סי’ שיח סי”ח, פרמ”ג במ”ז, שבה”ש מלאכות מבשל ס”ק כו. ועי’ חזו”א סימן לז ס”ק ט)) .

According to this opinion, the cholent should be lifted off the blech/hotplate (or moved to area [2] or [3] of the blech – see page 63) before water is added to avoid giving a mixing effect to the food while it is still on the fire ((הגר”א קוטלר זצ”ל הובא בס הל’ שבת להגר”ש איידר זצ”ל הע’ תרמג, הגרי”ש אלישיב שליט”א הובא בשבות יצחק עמ’ קצח, שו”ת אז נדברו ח”ו סי’ נו אות ב, שו”ת שרגא המאיר ח”ב סי’ נ. והמקור לדין זה הוא הכלבו הובא בב”י שכתב וז”ל “יש ליזהר מלתת מים בעוד הקדרה על האש לפי שהן מערבות ומגיסות בקדרה כדי לערב יפה וקי”ל דמגיס חייב משום מבשל אפי’ אם הקדירה מבושלת כ”צ כ”ז שהיא על האש”. ועי’ הערה לקמן בסמוך סברת המיקילים)) .

Nevertheless, others hold that there is no problem in adding water to a cholent that is on the blech/hotplate ((חזו”א סי’ לז ס”ק י, קצות השלחן סי’ קכד ס”ק י, הגרי”י פישר הובא במאור השבת ח”ב עמ’ שכו שהב”י הביא דעת הרשב”א שמתיר אפי’ עומדת ע”ג כירה א”כ באיסור דרבנן שחידוש הכלבו ודאי נקטינן כהרשב”א, ועוד משום שהשו”ע לא הביא חומרא זו ואין מסתבר להחמיר בדיני מגיס במה שלא הובא בשו”ע. וכ”כ להקל שו”ת שבט הלוי (שם), הגר”נ קרליץ הובא בתורת המלאכות ח”ב עמ’ רל, הגר”ח קניבסקי שליט”א הובא במאור השבת שם, שו”ת נשמ”ש סי’ ב. ועוד טעם להקל כאן משום שלשון הכל בו יתכן לפרש שהלשון “לפי שהן מתערבות” ר”ל שמא האשה תגיס כדי לערבב את המים והו”ל הגסה, כ”כ הגרש”ז זצ”ל שמדייק בלשון הכלו [הובא בשש”כ פ”א הע’ מו]. ויש עוד טעמים להקל בזה ע”ע במאור השבת באריכות בענין זה (ח”ב עמד שכד) וס’ שבת כהלכה)) , as long as it is added slowly ((דאל”כ יש לחשוש למש”כ הב”י סו”ס רנג מהכלבו דאסור ע”ש. כ”כ הגרש”ז זצ”ל הובא בשש”כ פ”א הע’ מב [מו] וע”ש מהגרש”ז שכתב שאם שופך בנחת יש היכר ולא יבוא כלל להגיס. וכ”פ הגרי”ש אלישיב שליט”א הובא בס’ מאור השבת ח”ב עמ’ שכד. וע”ש בשם בעל השבט הלוי דמותר ליתן מים לקדירה הן ששופך בכוח הן ששופך בנחת דכל שאינו מערב בכף אינו בכלל איסור מגיס)) .

  1. 5. חשש בשר בחלב

 

When pouring from an urn/kettle into a meaty cholent, steam could rise from the cholent onto the urn. Steam is equivalent to its source ((שו”ת הרא”ש כלל כ אות כו. וכ”ה בטור סי’ תנא ופרמ”ג שם בא”א ס”ק ל, שו”ת בית שלמה ושו”ת שואל ומשיב. וע”ע בספרי על הל’ בב”ח עמ’ 173 הע’ 3.)) [See Kashrus in the Kitchen p.173 for more details on this subject].

If hot meaty steam reaches the urn (or the spout of the urn), it may penetrate the walls of the urn, and not only render the urn fleishig, but may also make the water fleishig, thus, not allowing one to add milk to a coffee made with water from the urn.

Nevertheless, according to many Poskim, if the steam disperses immediately after leaving the pot, it does not retain the strength to impart its taste into anything it comes into contact with ((שו”ת הב”ח סי’ כד, רע”ק יו”ד סי’ צב ס”ח, ערוך השלחן שם, וכן שמעתי בשם הגרח”פ שיינברג שליט”א)) . Thus, the steam emitted from the cholent will not be absorbed into the urn and water.

Other Poskim are lenient since usually the steam will not be hot [yad soledes bo] at the time of it’s contact with the urn/kettle.

Those who use a cup to pour the water from the urn into the cholent do not have this problem ((ועי’ שבות יצחק עמ’ רד ששמע מהגרי”ש אלישיב שליט”א שאם יש חשש לבליעת טעם מקדירת השבת למיחם, אפשר להקל להעביר מים ע”י כלי אחר)) .

Those who do not use a cup to pour the water into the cholent can avoid this problem by removing the lid of the cholent pot before placing it under the urn (or holding the kettle over it) in order to let the main steam out, and then holding the cholent far enough from the urn/kettle that the direct steam of the cholent will not reach the urn/kettle.

ניצוק – One need not be concerned that the stream of water from the urn/kettle into the cholent connects the two and causes the urn and the water inside it to become meaty ((עי’ יו”ד ברמ”א סי’ קה ס”ג וט”ז שם)) . This is only a concern when one is hot, and the other is cold, but since here both are hot there is no concern, as long as there is no steam, as explained above ((חכ”א כלל נט סי’ ה. וכן פסק הגרי”ש אלישיב שליט”א והגרש”ז זצ”ל הובא במאור השבת ח”ב עמ’ שכב)) .

Q. If one wants to pour liquid from the cholent over his chicken/kugal, but it has already dried out, may one add hot water from an urn/kettle into the cholent so it gets the “cholent taste”?

A. Yes ((שו”ת נשמת שבת ח”ד סי’ ג-ב, כיון ששניהם כבר נתבשלו כל צרכן, תו אין איסור במה שיערבן יחד. וכ”כ שו”ת חת”ס או”ח סי’ עד שמותר ליתן מרק רותח על קטניות יבשים שנתבשלו)) .

  1. 6. חשש הטמנה – Insulation

 

Insulating food with something that adds heat is forbidden even before Shabbos. For example, submerging a potato kugal that is fully wrapped up into cholent.

If he knows that his cholent normally dries up during Shabbos, he may place a plastic cooking bag with water inside it into the cholent before Shabbos, and on Shabbos, when the cholent needs extra liquid, he can pierce the bag, allowing the water to mix with the cholent.

This does not present a problem of hatmana even if the plastic bag with the water in it is fully immersed inside the cholent, since it is not being insulated to keep the heat ((עי’ שו”ע סי’ רנז ס”ב)) .

Summary:

If one notices that his cholent is drying out and wants to add water, the following conditions must be adhered to:

  1. 1. The water that is being added to the cholent must be:
  • From a kettle that was on the fire with a blech or an electric urn,
  • Fully boiled and still hot (or warm acc. to ashkenazim).
  1. 2. The cholent that the water is being added to:
  • Is on a blech (or in a crock pot with layers of foil covering the heat element     [see page 26]),
  • According to some opinions it is best not to wait until it has completely dried out.
  1. 3. When pouring in the water:
  • According to some opinions, it is preferable to remove the cholent from the fire before pouring the water in. Other Poskim allow it to stay on the fire, but the water should be poured in slowly.
  • The cholent pot should be held away from the urn in order that direct steam will not reach the urn.
  • If a cup is used to transfer the water from the urn, it should not be placed down on the counter/table.

 

Note:

  • The lid of the cholent pot may have on it drops of condensation that have cooled down by the time he wants to replace the lid. These drops should be shaken off before replacing the lid, since returning them together with the lid, causing them to become hot may be considered bishul – cooking.

Placing Food on a Flame Before Shabbos

Q. May one place fully cooked food onto an uncovered flame before Shabbos?

A. When removing a pot of food from an uncovered flame before Shabbos (e.g., to remove some food to feed children before Shabbos), one should preferably not return the pot back onto that uncovered flame close to Shabbos ((מקור לדין זה הוא גמ’ שבת לח: ותוס’ ד”ה וב”ה, ורא”ש שם. ורא”ש שם מדייק במתנ’ שנקט “לא יתן עד שיגרוף” ומשמע דבשעה הראויה לגריפה מיירי והיינו בע”ש ואפ”ה קאמר לא יתן, ש”מ בע”ש חשוב חזרה. וכן פסק הרמ”א סי’ רנג ס”ב וכתב שהמנהג להקל אבל טוב להחמיר במקום שאין צורך כל כך. ועי’ בשלחן עצי שיטים שזה רק בגדר לכתחילה, וכ”ה בגר”ז שזה רק טוב ליזהר)) .

Chazal were concerned that if one were to be allowed to return food onto an uncovered flame close to Shabbos, one may come to return it to an uncovered flame on Shabbos. This prohibition only applies if the food is fully cooked before Shabbos. However, if the food is not fully cooked when one removes it before Shabbos, we are not concerned that a person will return a not fully cooked food onto the flame on Shabbos ((מ”ב שם ס”ק ע ועג בשם הרא”ש והטור. ואע”ג שלכאורה הוי גזירה לגזירה (לא יחזיר לפני שבת אטו חזרה בשבת וזה רק גזירה משום חיתוי), כבר כתב הרא”ש שזה גזירה אחת. ודין זה נוגע למי שתופס כדעת החזו”א דבלעך אינו נחשב כגו”ק, ולכן נותן קדירה שנתבשלה כמאב”ד דמעיקר הדין אי”צ גו”ק. אבל לשיטה זו סמוך לשבת אותו זמן מיקרי חזרה שצריך גו”ק ובלעך לא מהני. ובפרט בפלטה חשמלי שלא יכול לבשל מהר ולוקח הרבה זמן לבשל, א”כ אסור למוך לשבת)) .

Note:

  • If one intends to remove and return food on Shabbos from and to the fire, a blech will be required in any case.

Q. How long before Shabbos is it forbidden to place a pot of food on an uncovered flame?

A. The amount of time it would take to heat this food if it was cold ((רמ”א שם. וע”ע בחוט שני ח”ב עמ’ קכד הרבה פרטים למעשה ע”ז. ואפי’ היא רותחת דיינינן לה כאילו היתה צוננת. ושיעור הנ”ל אינו נמדד בגודל האש שמונח עליה הקדירה עכשיו אלא באש הכי גדולה שאפשר לעשות בכירה זו, ס’ אוצרות שבת עמ’ קטו בשם הגר”ח קניבסקי שליט”א, וז”ל שם “שמעתי בשם החזו”א שאפי’ מעמיד על גבי אש קטנה כיון שאילו היה מעמיד ע”ג אש גדולה היה יכול להרתיח מותר)) . Many people accept Shabbos quite a while before Shabbos actually begins (שקיעה). An average sized pot placed on the fire at that time can become hot in a relatively short time, thus, there is no concern ((ושיעור זה אינו תלוי על הזמן שהוא עצמו מקבל שבת אלא קודם השקיעה, מ”ב ס”ק עא)) . In a case of pressing need, one may rely on the lenient opinion that allows the pot to be placed on an uncovered flame even close to Shabbos ((רמ”א שם “וטוב להחמיר במקום שאין צרך כל כך)) .

Q. What if the flame is covered with a blech (or it is a non-adjustable hotplate that according to many Poskim doesn’t require a blech)?

A. This restriction does not apply and food may be returned onto the blech even close to Shabbos ((גר”א סי’ רנג ד”ה דינו כמו, מ”ב ס”ק עב. ועי’ ס’ שבת בשבת (להגרמ”מ קארפ שליט”א) עמ’ רמד שכתב דאפי’ לפי המחמירים (חזו”א ועוד) דלא נחשב הבלעך לגו”ק, יש לסמוך לכו”ע דחשיב גו”ק בע”ש משום הרבה פוסקים מקילין בגזירה זו וכן דעת השו”ע ואף הרמ”א שמחמיר כתב טוב להחמיר במקום שאין צורך כ”כ וע”ש עוד טעמים)) . This is another reason why it is always good to put a blech on the flame.

חזרה through a Non-Jew

Q. May one ask a non-Jew to return food that was removed from a blech in a situation that he himself may not?

A. Although normally one may not ask a non-Jew to perform an action that he himself cannot do, in a case that the food is needed for a mitzvah (e.g., it is one of the main dishes of the Shabbos meal) or to prevent a financial loss (e.g., a caterer that may lose a substantial amount of money if this food is not served), a non-Jew may be asked to replace the food directly on the blech ((פרמ”ג א”א ס”ק לז ולח, ערוה”ש, בה”ל שם ס”ה ד”ה להחם. ולמה כתב הבה”ל “והמיקל אין גוערין בו”? אמר לי ידידי הרב אברהם הקשר שליט”א שכתב שם להקל רק במקום “צורך שבת” ועי’ בסי’ שכה ס”ט ברמ”א שם ומ”ב שם ס”ק ס שסתם צורך שבת יש להחמיר באמירה לעכו”ם ורק לדבר מצוה גמורה וכו’ יכול להקל לכתחילה, וז”ש הבה”ל לשון “אין גורעין בו” משום שצורך שבת אין צורך כ”כ להתיר אמירה לעכו”ם לגמרי. ואח”כ שמעתי כן מהגרפ”א פאלק שליט”א. ועי’ שו”ת אז נדברו ח”ח סי’ טו דאין לעשות כן באופן קבוע)) .

However, according to some opinions, this is forbidden ((חזו”א סי’ לז ס”ק כא ד”ה ונראה שס”ל שאין הנתינה על המקום החום הוא האיסור, אלא האיסור הוא עצם מציאות הקדירה על הבלעך, א”כ הרי יש כאן רק שבות א’ ואסור לומר לגוי באופן זה, וכ”כ בשו”ת מים רבים סי’ כג ותשו’ כנה”ג סי’ מז. וע”ע בס’ ברכת שבת שכתב, אם בא להחזיר לפלטה חשמלי, אפי’ החזו”א מודה שמותר)) and if a non-Jew put the food on a blech, it must be removed immediately.

חזרה באיסור – דיני מעשה שבת

 

Q. What if one returned the cholent without realizing that it wasn’t fully cooked (e.g., on Shabbos night), may it be eaten?

A. If it was half cooked when it was returned to the source of heat (i.e., half of the time it normally takes to cook, or in difficult circumstances, a third), the food may be eaten ((בה”ל סי’ שיח ד”ה אפילו בעודו, שכיון דיש פלוגתא אם יש איסור בישול אחר שנתבשל מב”ד, אין לאסור בדיעבד. ע”ע שם במ”ב ס”ק ב)) .

Q. What if one returned the food when it was forbidden to do so, e.g., the food was placed on an uncovered flame; may it be eaten?

A. It depends if the food was improved or not:

  • If the food was already warm and wasn’t improved by returning it, it may be eaten (( שו”ע סי’ רנז ס”א, מ”ב סי’ רנג ס”ק לה, חזו”א סי’ לז ס”ק כז ד”ה החזיר “ודין זה אפי’ החזירו במזיד”.)) . This is because no real benefit was gained by returning it.
  • If the food was improved or was heated up as a result of returning it, then it may not be eaten on Shabbos ((שם כדין חזרה שהחמיר הרמ”א סי’ רנג ס”א. ועי’ מ”ב סי’ רנג ס”ק לה שהטעם שמחמירין בחזרה יותר משהייה משום דקעביד מעשה. ועי’ בגר”ז ס”ק כד שצריך להמתין כדי שיעשו אחר שבת, אבל אם עשה כן (במצטמק ויפה לו) בשוגג, מותר לאחרים שלא הוחזר בשבילם לאכלו אפי’ בשבת עצמו. אבל לבני ביתו אין להתיר שבשבילם הוחזר)) . This is because real benefit was gained by the forbidden action. Nevertheless, since it was already fully cooked, someone else (i.e. not the one that did it) may eat it on Shabbos ((מ”ב סי’ רנג ס”ק לה)) .
