Chametz Outside the “Place of Sale”

Question:

If one forgot to place a chametz item (bottle of perfume) in the designated place for items to be sold, and then it sat out over Pesach. What’s the din? It was certainly the kavanah to have the item sold.

Answer:

It is fine, and one can continue to derive benefit from the item after Pesach.

For safety’s sake virtually all contracts (between the rabbi/envoy and the non-Jew) mention “or in any place” in addition to the designated place where chametz is to be kept. This is done for safety’s sake, to included cases such as yours.

The sale therefore applies to all items, and you can continue to benefit from them after Pesach.

This is the more so true for perfume, which is only a concern for chametz, and not actual chametz.
