The Chavas Daas in Siman 105 Sif-Katan Beis brings from the Toras HaBayis that terumah is considered “heteira bala.” Are there any cholkim on this?
Answer:
Several poskim write that Terumah is considered “heitera bala” — see Aruch Ha-Shulchan (Yoreh De’ah 93), Chelkas Yaakov (12), Derush Ve-Chidush of Rabbi Akiva Eiger (8, 8), among others.
However, the Radak (18) writes that Terumah is considered “issura bala”, and this emerges from the Ra’a (Shita Mekubetzer, Kesubos 87b and Bedek Ha-bayis 37a).
See also Rav Shmuel Levi, in Binyan Av (Bakshi-Doron, on Chalah, p. 63), who suggests that even the poskim who write that it is “heteira bala” will concede that concerning “nat bar nat” it is considered issura bala (with the exception of the Rambam).
