In regards to dinei chatzitzah by tevillah are there any shitas (in achronim, rishonim, or earlier) that a chatzitzah that’s a “miut hamakpid” is chotzetz min haTorah?
Answer:
Some understand that this is the opinion of Rashi, Sukkah 4b and Eiruvin 6b (see Tosafos and the Rosh). See also Ran, Shevuos 7a (in Rif), and Shut Avnei Nezer (252).
However, all other Rishonim understand that mi’ut ha-makpid is only a rabbinic chatzitzah.
