Warranty Questions

Shalom Alekhem,

I am in the cell phone business. Phones which are still under warranty and they break, The Company replaces them with a new refurbished hand set. I had two questions;

1) For phones that are under warranty; is one allowed to break the phone and get a new refurbished one from The Co. while they’re under warranty?
It is a very common thing and the companies I believe are some what aware of what is going on, but they still accept the returns for a refurbished one.

2) My second question; The warranties which the companies gives comes with the serial number in the back of the phone. If one buys 2 phones; one with warranty and the other one with out warranty; is one allowed to take the warranty of one and use it for the other phone that originally didn’t come with warranty? (He’s not using the warranty twice; he’s just using it on a different phone and can’t use it again on the phone with had warranty originally.)

Answer:

1) It is certainly not permitted to intentionally break a phone and get a new one. The warranty is obviously given for phones that break, and is not intended for people who want to get a new phone every year by breaking their old one. Doing so is cheating the company (breaking the terms, which I’m sure are written but even if not are plainly obvious), and therefore forbidden.

2) Again, this depends on the terms of the warranty. Under the assumption that a warranty cannot be transferred, this will not be permitted. The warranty is given under particular terms and condition, and it is forbidden to use the warranty beyond the terms and conditions with which it was given.
