I have some questions regarding divorce.

My husband and I got married in Israel in a private religious ceremony. It was not done by a recognized rabbi… not through the beit din and not civil.

We have one baby, who is now 3 months old.

1. What is the status of our marriage?

2. How can we get divorced halachically correct?

Is it enough that my husband will sign the get with 2 witnesses and give it to me?

3. What about the recognition of our son?

Answer:

1. The status of the marriage depends on the way in which the ceremony was conducted. You will have to refer an authority to the rabbi who officiated, and investigations can be made. Without investigating there is no way of knowing.

2. If you require a divorce, this can be done through the rabbinate beis din, who will ensure that everything is done properly.

In general, marriage and divorce should never be done “privately.” It is a serious affair.

3. The son is a kosher Jew irrespective of the marriage status.
