Can the claimee or the defendant use a toen or shaliach in bais din?

Yes, it is today the common custom for both parties to use a to’en in Beis Din.
Although according to the original halachah a distinction was made between the plaintiff and the defendant (see Choshen Mishpat 124), this is no longer practiced (see Sema 17:14), and there are important reasons to permit this in ensuring that each side gets his “say” in Beis Din.
