Free Use of Microsoft Programs

This past week, someone in our community asked if anyone could benefit from an older version of Microsoft Word (2007). Since my wife’s laptop computer does not have any of those programs, I agreed to take her old disc. However, I then realized that it might be stealing to take a disc that was once used on somebody else’s computer and put it on mine. Is it permissible for me to use the old version, or would my only recourse be to buy my own new version?

Answer:

Microsoft programs generally come with a code that allows them to be installed on a few different computers [around 4], this would certainly be permissible as they have sold the rights to use the program on 4 separate devices. If the program is not being used on the old computer and will be only used on yours, this would be permitted in any event as you have purchased the right for at least one user.

Otherwise, many authorities maintain that copyrighted programs, which are protected under the law, may not be copied.

This can be because of principle ownership of copyright, but according to most it derives from other halachic principles, such as deriving benefit at another’s loss, the obligation to abide by the laws of the land, and others.

It remains hard to prohibit this outright in halacha, but in deference to many authorities who are stringent, one should not do so.
