Question:
My pediatrician advised me to pull my 24 month old child out of his playgroup due to serious concerns about his well being while he is there (He does not eat, sleep or talk while he is there) Am I mechuyav to pay for the rest of the year?
Answer:
If there were no indications of a problem at the time you signed up in the beginning of the year and you didn’t pay up front and there is nothing written in the contract you have with the one who runs the playgroup and there is no well-known custom then you can pull your child out and don’t have to pay because it is an onness as in Choshen Mishpat siman 335.
