Question:

A husband and wife are planning on divorcing but are living in a house together. If the husband pays for the rent, car lease, insurance, her cell phone and some of the food expense while the wife puts away her paycheque to herself, can the husband claim some or all of her accrued pay check towards the kesuva payout?

Answer:

If you are indeed paying her expenses, food etc. and she is not giving you her pay check, then she owes you that money, you can claim it in bais din. It would however be a good idea to make a ma’acha, (voice your disapproval) to her not giving you her pay check in front of two people so that she will not be able to say that your forgave and were mochel it.
