Sefirah or shema first?

Question:

If one were to daven Maariv before tzais haccocavim and when it comes time to say sefirah it’s after tzais, should he say shema first as in a regular situation or say sefirah, aleinu and then shema?

Answer:

It would depend on when he davened marriv, and if he davened maariv in a place that it is considered halachically night or not. If it can be considered halachically night then he should say sefira first, but if not he should say shema first. If you aren’t sure then say shema first.
