I want to seize property in lieu of money owed to me.

Question:

I manage a restaurant that owes me an amount of money. They clearly owe it to me by all accounts, everyone agrees, but they have asked me to wait for it. However, they have a large selection and storage of wine. So I wanted to know if, Al pi halacha, I can take wine, instead of the money owed to me and tell them. If I say it before I know the owner will say no, but if I say it after I take it, I know he won’t argue.

Answer:

A person can not just sieze money for someone else, if there is a bais din to go to. Therefore you shold not just take the wine from the owner.
