cashing found check

Question:

  1. I found a NY State treasury refund check made out to a non-Jew what is the din may I cash it send back to NY state with letter that as a religious Jew I am returning it or just throw it out? What is the din and what is the best thing to do?
  2. Also I am selling product for someone and he posted a sale and we forgot to give sale price to costumer and they did not request it are we obligated or should we call them back to give refund?

  1. The best thing to do would be NOT to cash the check. A person that loses a N Y tax refund check can call the IRs and they will trace the check. If they find that it was you, you might cause a chillul H-shem, and it might also be illegal to do. Therefore call 518-457-5181, and tell them that you are Jewish, and you found this check, and you want to know what to do with it.
  2. If the customer is Jewish then the money has to be returned, but if he isn’t then technically you don’t have to return it, however it should be returned because it might cause a chillul H-shem. As a side point, it isn’t clear to me who is the owner of the extra money that was paid, you or the person you are selling for. Regardless though both of you should agree to return the extra money that was paid.
