Knas of Kdei Sheyase

Question:

1)Is there a knas of Kdei Sheyaseh – that if a gentile did the melacha of
a) hotzah for for a jew
b) went outside the techum for a jew

2) If there is – how is one allowed to shop in a store that received deliveries on shabbos; shouldn’t the person have to wait a few hours (how long it took the truck to drive the food) before shopping?

3) What about a Dunkin Donuts or a Kirspy Cream – where the donuts are cooked on shabbos – can one go there right after shabbos, or must the person wait kdea sheyasah before shopping there?

Answer:

Without getting into the issue of how can a store that is open on shabbos have kosher supervision then. The gentile doing melacha for the store is doing it for the storeowner, who is the one paying him, and not for the stores customers. If the storeowner is a gentile, then it is a gentile doing melacha for a gentile and there is no issue there at all. If the store owner is a Jew and has his store open on Shabbos that is different problem, because the food is not only assur bkidei shayasu, but forever.
