Going to a Bais Din

Question:

Thank you for your time. Rashi says, “You have none else but the judge that lives in your days” on Dvarim 17:9. My question is, what if it is an unrighteous generation and all of the judges are committing Issurim? Would it then be permitted to go to them? Also, what if a person wanted to convert? Would it not be permitted to?

Answer:

That is a pretty accusing statement. ALL of the judges of the generation are unrighteous? Yes it is possible, that everyone in the generation has commited aveiros, as it says כי אין צדיק בארץ אשר יעשה טוב ולא יחטא”.  Yes, everyone makes mistakes, and no one is perfect, even Moshe Rabeinu had a sin, but we say that if a tzaddik has sinned, we assume that he did teshuva for it.

Yes it is permitted to go to them, and as far as we are concerned they are totally righteous.

  1. Thank you very much for your reply and help. If the judge sins while a person comes to them for judgement, can they stay and accept the judgement in an unrighteousness generation or are they required to rebuke them and leave, even though they may not find better? Thank you again, I really appreciate it.

    1. I need to know the specifics of what you are referring to.
      Thanks
