The first Siman in Choshen Mishpat, what cases do Batei dinim judge today? For example, if my dog (assume i didn’t guard it properly) bites and kills my neighbour’s cat, and it is an expensive cat, would Bais Din judge this today and aware money to my neighbour?
Answer:
Bais din would officially give a ruling on it, and force you to pay because it is nizkei beheina, especially that it is a damage that isn’t normal, (keren- which is a knas). Nevertheless you would still have to pay the person for the damage that your dog did.
