It is only considered gezel when a person eats something and he was supposed tomake a bracha but didn’t. According to halacha, since in this case he is not supposed to make a bracha because of safek brachos lehakel, it is automatically not considered eating something in a way that he shouldn’t have. The reason it is gezel is because he denied Hashem his bracha, but since safek brachos lehakel, he wasn’t supposed to make the bracha.
