Possibly missing Krias Shema

Question:

A person who is up until 3 in the morning for some reason and knows that he will almost certainly miss zman krias shema if he goes to sleep (even if using an alarm clock, or if not possible to set one), may he go to sleep anyway or is he obligated to remain awake until the earliest time of krias shema?

Answer:

If he will surely miss the zman then he has a problem with going to sleep because he will not say kriyas shema. However if it is only a suspicion and a fearthat he will miss it then he is a llowed to go to sleep. This is similar to the halachos of things that we are allowed to start before the zman of mincha )O:CH 232-2) even though there is a fear that he person might forget himself and miss the zman.

Best wishes
