Damage in store

Question:

You’re at an Apple store and you leave your cart with several apple products on the edge of the counter. You decide not to buy them and leave the cart there without telling anyone. Someone else comes and tries to reach over your cart, and unintentionally, knock everything over. Is it your fault for leaving it there, knowing it was risky or is the person responsible for the damage?

Answer:

It is not possible to give a definitive answer in such a forum however here are some guidelines. If the other person tried to reach over your cart, obviously he person saw the cart and should have been more careful.  If however the situation is such that the person can say that he couldn’t see the item, then it is possible that you would have to pay for it, as when you picked it up, you became a shomer on it.

Best wishes
