Phone conversation recordings

Question:

There are programs that can be downloaded on phones that will automatically record your phone conversation with another person. One situation in which this could be very practical is where you might want to replay a conversation with a Rav about a particular shaila you asked, particularly if the answer is very detailed and might be difficult to remember. Are there any issues in using one of these programs? Does it depend on whether you would share the recording with someone else or just keep it for yourself? Thanks

Thank you for your question.

There is an issue with using such a program. It is geneivas daas to record someone against his will. The person thinks that he is having a private conversation, and he is acting accordingly the way he would in a private conversation. This would even apply to a shiur, which is said in public, however often the speaker does not want to be recorded for a variety of reasons. This would apply even if you are not giving it out to others to listen to. If you want to record what your Rov is answering you, you should notify him beforehand, so that he knows that what he says will be saved.
