Question:
Ha Rav, we use a plastic bin that we put a trash bag in. I saw plastic plates sticking up and I pushed them down on the partially filled trash bag and slide the plastic bin to the side of the under the sink wall with my hand in a regular way. Did I break Shabbos?

This is a very practical question, that can come up often on Shabbos; is the garbage can muktza or not? If the garbage can had muktza inside it before Shabbos, such as inedible food[1], and according to many poskim[2] even disposable plates or cutlery, then the garbage can is considered a bosis to the garbage, and may not be moved in a normal manner. If it is disgusting and disturbing, it may be moved to a place that it will not disturb. However, if the garbage can did not have any muktza inside it during bein hashmashos (the time period between sunset and nightfall), then the can is not a bosis, and when needed the garbage may be moved when needed. This is because the garbage in the can is only being moved “tiltul min hatzad” (moving the garbage thru a different object), which is permitted if the can is needed, i.e. to bring to the table. (As a side point this is a good reason to dump the garbage before Shabbos, aside for the practical aspect of it.)
Regarding pushing down the disposable plates etc. in the garbage. There is controversy among the poskim if disposable plastic plates forks etc., that were thrown into the garbage on Shabbos if they are considered muktza or not. Some poskim[3] hold that since these items are no longer going to be used, they are muktza. A number of other poskim however say that since technically a plastic plate or fork (not paper) can be reused, coupled with the fact that it is still whole, that it is not muktza[4] even though it was thrown in the garbage on Shabbos. Therefore, although it would be permitted to push the plastic plates down, it is preferred to push them down with your foot, etc. If the plastic plates were put in the garbage before Shabbos, then they would be similar to what we discussed regarding the garbage can. It would however be permitted to push down the garbage with your foot[5], if you need more room in the can.
