My son asked me a question that i did not know the answer to.
Why is there no Issur Sfichin (prohibition to eat vegetables that were grown in Eretz Yisroel during Shmitta) on bananas. That since we make a Ha’Adomah on it shouldn’t it be included? I have seen bananas on sale here in Israel, both from fields owned by non-Jews and grown in fields but sold by a Beis Din.
Answer:
Not only did he ask a good question, according to the Rambam he is correct and they are not permitted during shemitta if they have an issue if sfichim[1]. This in fact is the way some Sefardim hold[2]. Other Rishonim (Rash, Rosh) and most poskim however hold that if he started to grow before shemitta (some say if the stem was there, and others say the actual fruit had to start growing before shemitta) that is would not have an issue of sfichim. This is the minhag of the Ashkenazim[3], and some Sefardim. Another reason the poskim are meikel is because the issur of sfichim is only on things that give fruits during the first year after being planted, however if it only gives fruit after a year there was no geziera. The reason is that even if it was planted during shemitta, it would give fruits until after wards. Newly planted bananas don’t give fruit until a year and a quarter after being planted.
