Billing special ed teachers

Question:

Hello dear Rabbi,

My question is regarding billing a special education agency in NY for hours that a student could not show up/cancellation etc. The problem is that the agency bills the Department of education, I’ve heard that the department of education only allows to bill if you have worked with the student but I have not seen any proof of their policy on it. I asked a local rabbi his opinion and he told me as long as the agency is ok with it I can bill. What is your opinion and where can I find more information regarding this case ?

Hello,

My opinion is like your local Rabbi told you. You are being hired by the agency, and if they say that in a particular situation, that you are allowed to bill, you may. You do not have to be concerned with what goes on between the agency and the department of education.
