Cutting down tree in garden

Question:

I have learned that to cut down even a non fruit-bearing on one’s property can be viewed by the heilige poskim as an extremely serious and chas veSholom dangerous action. There is kein ayin hora an extremely high leylandii \ conifer in the garden, higher than the house, and I would like to know if lechatchila it would be all right for this to be cut down. Trees of this kind kein ayin hora can grow a lot each year. I have not been told that it is a danger. It does not block the sunlight from coming into the garden except for early in the day. It does suck up moisture and nutrients from the soil and garden area immediately around it. I would not want the thing to be done if chas veSholom it could cause harm. It is a very expensive procedure. I would be very grateful for deep and thorough Torah advice. Thank you.

Let’s go through some of the halachos to clarify things. The basic halacha as written in the Rambam[1] is that a non-fruit bearing tree is allowed to be cut down.  Nevertheless, they should not[2] be cut down for no reason as this would baal tashchis, to just kill and ruin the tree for no reason.

There is an opinion[3] that we person who cuts down a non-fruit bearing tree will not benefit from what he did. However, most poskim[4] do not agree with this. All agree that there is no danger to cutting down such a tree. Additionally, the poskim say that if the person has a use for the tree[5], (the person needs it for wood), or if the tree is causing one harm[6], that it is permitted.

Regarding your situation, if the tree is sucking up the nutrients from the garden around it and harming the other plants, it is permitted. Otherwise if it isn’t causing you any harm, why would you pay for something expensive for no reason?

[6] וע’ בשו”ת משנת יוסף ח”ח סימן ו, שכשקוצץ אילן סרק מחמת היזק שיש מחמתו לא שייך חשש זה.
