Question:
I entered my child into a playgroup, but after a month, finding the care and hygiene to be much desired, I removed my child from the playgroup. They want me to pay, as per the contract, for the full year.
Aside from the above, their enrollment was full when my child came, so there was no lost place to fill
Thanks
Answer:
Hello,
In general, the contract is binding, regardless if they lost money from your leaving or not, as you entered an agreement with them which is binding. On the other hand, if the conditions were substandard to the degree that the Bais Din would say that it was a mekach taus, then you might be exempt from paying. Hwowever there would be a need to know more of the specifics, and to hear what the playgroups owner has to say about it.
Best wishes
