Threatening legal action to recover money owed

Question:

A business owes me for an invoice that was due for six months. They keep delaying, telling me they will pay soon—this week, next week, etc. I've heard from other creditors of theirs that filing a lawsuit resulted in immediate payment.

Am I allowed to send a demand letter stating that I will file a claim in small claims court if payment is not received by a given date?
(To be clear, I would not file without a Heter Arkaos.)

Hello,
If the person is a non-Jew or irreligious Jew then to you can send him the letter. However if the person is a religious Jew, then first see if it can be settled in Bais Din. If that won’t go, then you can send him the letter.
