Employment, Yom Tov pay

Question:

An employer promises to pay his employee his weekly wage even on yom tov. Their contract allows termination at any point but requires 30 days notice. The employer fires the employee, giving him notice exactly 30 days before Yom Tov. can the employee claim his yom tov pay? The employees claim was that Yom Tov pay is tied to work done before Yom Tov. Furthermore, the timing on the dismissal meant that he could not find another job in this time frame that would pay him yom tov, since nobody starts a contract beginning with Yom Tov. Therefor any job he took would begin after Yom Tov

Answer:

Hello,

If you were still hired on Yom Tov then he must pay you for it, as this is part of the original agreement, as Yom Tov is the 30th day. The fact that the employee couldn’t start new work on Yom Tov is not the employer’s responsibility. He is just responsible to give you 30 calendar days advance notice before he stops paying you.

Best wishes
