When to Say Birchas Hatorah

Question:

Hi..........I am trying to gain clarity on a few scenarios which may occur related to when to say Bircas Hatorah.

1) I fall asleep for at least 30 minutes after midnight without saying Hamapel/Shma. If I want to go back to sleep and say Hamapel/Shma(HS) do I recite Bircas Hatorah and say HS, do not recite Bircas Hatorah and say HS, or not say HS at all?
2) I fall asleep for 30 minutes after micnight, and awaken and want to learn Torah before I fall asleep again. Would I say Bircas Hatorah at the time I wake up, with the intention that I will say Bircas Hatorah again when awakening the second time to begin my day? Related to this, can I say Bircas Hatorah the first time I wake up with the intention that it should cover the entire day, and therefore not say it again upon awakening a second time to start the day?
3) I awaken to start my day before Alos Hashachar. Can I say Bircas Hatorah at that time, or wait till Alos Hashchar to say Birchas Hatorah and not learn until then?
4) I know there is a chance I will fall asleep or consciously go to sleep while learning. Can I say Hamapel/Shma before even if I dont go directly to sleep? In other words, can the learning be considered to begin the process of going to sleeep and therefor OK to say say Hamapel/Shma before learning? Thank you for considering the above scenarios!

 

Answer:

Hello,

  1. There isn’t any difference between sleeping before[1] or after midnight regarding these halachos. Even if you went to sleep for the night at 10 PM, and slept for five hours, and woke up at 3AM. T you remembered you didn’t say Hamapil and Shema, you can say then[2], without Birkas Hatorah. The reason is because you are saying everything as a shmira, and tefillah and not as learning torah.
  2. If you wake up in middle of the night and want to learn, you should say Birkas Hatorah. You do not[3] have to say it again in the morning, however if you want to you may.
  3. You should say Birkas Hatorah even though it is before alos hashachar. Birkas Hatorah has to do with the new day[4], not when the day technically starts, unless one was up all night.
  4. If the learning is part of the process of your going to sleep, you can[5] say hamapil beforehand. If you are not planning to go to sleep but it is only because here is a chance that you will fall asleep, then you shouldn’t say hamapil beforehand.
