Question:
Thank you for the very informative articles you send out each week!
In "Salary of a Repairman who Used a Delivery Service that Delivered Four Years Late" (parshat bo), you conclude that the worker did everything which they were expected to do. However, in the question, she says "no one sued the delivery service". As the worker who sent the wig is the customer of the delivery company, was it not her responsibility to follow up when the delivery was lost? Did that only become a moot point now that it was found? Did the wig-owner release her from this responsibility by silent acquiescence? Or something else?
Answer:
Answer by Rav Yosef Fleishman shlit"a
You are correct-If the owner would have asked for her sheitel back four years ago-she could have demanded it from the lady who fixed it and she could have made the delivery company pay and given the money to the owner of the sheitel and kept 4000 for herself-This is a Gemoro in BM 35A and then they would have had a question now that the sheitel was found -we wrote abt that question in the past.
I would not say release her but that by not demanding her sheitel the repair lady didn't have enough pressure to pursue the matter
All the best
Yosef
