Someone crashed into my wife (who is fine, bH) and they admitted fault. There's also a witness. The insurance company told us that they're only willing to pay 50% of the claim. My insurance told me that we should take them to court and they (my insurance company) will deal with everything. Do I first need to try to take them to beis din? If so, my insurance company said that they can't get involved. If I don't need to take them to beis din, do I at least need to get an ishur from a beis din? Finally, I am hoping that once they see that I am willing to go to court, they will give in to the entire claim. Can I tell them this in the hope that they'll give in, and if not, then get the ishur from the beis din? For reference, we're in Eretz Yisroel. Thank you

As long as both parties agree that there was a crash and money is owed, you can take the insurance company to court, and you don’t have to ask the Bais Din. It is common knowledge that insurance companies don’t go to Bais Din, therefore you don’t need to ask them specifically.
