Question:
My bank account was hacked at an American bank. The bank refunded the money, as that is the law and the bank's practice. I was wondering halachically, if it were all Jews, what the halachah would be. Is the bank a shomer sachar and chayav in geneivah, or is it an ones of the bank? What would the Shulchan Aruch say in theory?
Thank you
Answer:
Hello,
It would still be permitted to take the money from them. First of all, the bank is not a shomer sachar but rather a shoel, because they indeed use your money, and they are chayiv on an ones. Secondly, these are the agreed-upon terms.
Best wishes
Why is the bank considered a shoel and not halva'ah, considering they want to spend and invest the money?
Correct, that it what I meant.
