If there are cosigners, you should turn to them first. If that isn’t an option and the loan was given with a shtar, you would need to go to a Bais Din first to obtain permission to go to court, as Hotza’ah Lapoel will not take the money from the borrower unless you have a court order or a psak from a Bais Din.
