2nd hand sales question

Question:

I sold a kosher phone, “Firstphone” to someone for 100 shekels. My daughter had used it for 2 and a half to 3 years. It seemed okay, though it sometimes charged slowly, and my daughter didn't use it that much. The woman who bought it from me told me that after a month it stopped working, and the phone guy couldn't fix it and didn't know what the problem was. Do I need to give her the money back?

Answer:

Hello,

You do not have to give her the money back. A person buying a used phone knows it might not last forever. Secondly, we don’t know that, at the time the phone was sold, it had any problems. In fact, the phone guy doesn’t even know what is wrong with the phone now. So who says it had a problem from the time it was sold? Maybe the person who bought it did something to it. After all, it worked fine for a month. Therefore, you do not have to refund the person his money.

Best wishes
