Maaser

Question:

Can the following be considered a tithe (maaser):
1. Son's cheider tuition
2. Son's yeshiva gdola tuition
3. Paying for daughter's seminary
4. Paying for daughter's professional training (grade 13-14)
5. Paying rent for a married daughter whose husband learns full time?
6. Paying mortgage for a married daughter whose husband learns full time?

Hello,

Before getting to the technical answers to your questions, it should be noted that if one can afford it, one should preferably not pay tuition from maaser money. You will not lose out by paying tuition from your own money because it is “hotoas bonov l’talmud torah,” not included in the parnassa that is decreed on Rosh Hashana, and the more one gives, the more Hashem will add to his parnassa. (Shulchan Aruch Horav Talmud Torah 1-7 Footnote D:H Ach). Additionally, see Teshuvos Vhanhagos, which states that when one pays their tuition from maaser money, they are essentially losing out on the mitzva of paying for their child’s learning, since the money was taken from the maaser money, not theirs! Having said this, let’s get to your questions.

  1. A son’s cheder tuition should not[1] be taken from maaser money because it is a personal obligation on the father. As a side point, according to R’ Moshe Feinstein zt”l, this includes Yeshiva Ketana or Mesivta until the boy is 16 years old.

It should be noted[2] that if the school charges some parents more because others are not paying full tuition, the extra amount is not the actual cost of teaching, but rather money to support the school where the child learns. For example, if the cost to the school per child is really 6k a year, but they charge 8k to offset the fact that some parents can’t or don’t pay tuition, the extra 2k is not the cost to teach is so torah, but rather money to support the school. Therefore, those 2k can be taken from maaser money.

  1. This is controversial. Some poskim[3] hold that one may use maaser money for Yeshiva Gedola, because the father technically is not obligated to pay for their tuition. )With the exception of the amount the father saves on food bills because the Yeshiva feeds his son(. Others[4] say that since is the norm nowadays for the father to pay tuition for his children, and he would pay for it anyways, because this is the norm nowadays, therefore it is considered his obligation and maaser cannot be used for it. (If the father is not able to meet his monthly bills, he may use maaser to pay the tuition[5],   because then it isn’t worse than giving himself the tzedakah.)
  2. It is permitted to pay for seminary from maaser money, as the father is not obligated to teach his daughter at this point, and not everyone is paying for their daughter to go to seminary. (See footnote[6] for some exceptions.)
  3. One may use maaser for this, as a father is not obligated to send his daughter for professional training.
  4. It is permitted[7] to use maaser money to support one’s son or son-in-law’s learning in Kollel by paying their rent, mortgage, or other expenses. Supporting Torah learning is a great mitzva, and this support takes precedence over many other tzedakahs. One should, however, be careful not to give them all of one’s maaser money, but to save a considerable amount for other causes.

It should be noted that if the father obligated himself before the couple married to support his son or son-in-law, that support then became a personal obligation, and maaser cannot be used. Therefore, it is important for all potential fathers to stipulate before obligating themselves to support the young Kollel couple that it can be taken from maaser money..
