Renting for Store Open on Shabbos

Three people who a shutfis in a building. One is a frum person, the other 2 are not. Someone wants to come along and rent a chelek of the binyan for his store. However the store will be opened on Shabbos. Is it muter to rent to him?

Answer:

If the person owns a unspecified part of the building, he has to object to renting the building for a store that will be open on Shabbos.

It is not permitted to rent one’s property for this purpose, because this involves “abetting” violation of the Shabbos (there might also be an issue of lifnei iver, depending on where other property is available, and on whether the other property is owned by Jews or non-Jews — according to some authorities, even if other property is available, if the owner is Jewish this will not resolve the issue of lifnei iver).

Therefore, as a partner in the property, one must object to rental for this purpose.
