Social Security based on Salaries

I work for company that people are paid under my name because they aren’t Israeli citizens. IYH I am expecting in a few months and I will receive money from Bituach Leumi after birth because my tlush says I am receiving more that I get paid, I will be getting “extra money”. The other women get paid after the 3 months of chofesh leidah by the school, meaning that this money if free for the taking.

What is the status of this money?

I was told I couldn’t use the money. Now the problem is that D’mei Leidah is determined by the last three tlushim, I am IYH due in December which means my three tlushim would be September, October, November. My problem is (because I didn’t know this before hand) that the two women were already paid under me for September

I can change around October and November.

What do I do in such a situation? Can I pay the women with the money I get from bituach lemui?

Also–There is a path I take to drop my daughter off a gan (there is a small shortcut). The path is very narrow at one end, and hard to push the stroller, right next to it is a small wall and someone’s mirpeset. I am I allowed to pick up the stroller and wheel it across the marpesat in order to avoid the narrow path? Or is it not a rishus harabim? Or should I just ask them for permission?

Thanks.

Answer:

Concerning the money, taking demei leidah from bituach leumi for salaries that are not yours is a problem, and if there is any way of fixing it is should be remedied. I don’t know if this is feasible or not.

Concerning the path, it is possible that the mirpeset is part of the public domain, but this is hard to tell without asking. Even if it isn’t part of the reshus harabim, it it is generally used by the public, it will be permitted to cross (this is known as a meitzer she-hechziku bo rabim). From your description this might well be the case. But if it is not generally used, it will not be permitted to cross it.

Best wishes.
