Bought on Grey Market

Hello, at my school we have a homework project to solve an ethical situation. My situation goes as follows.

One Man wants to buy limited edition shoes. Sadly, the shoes sell out before he can buy them. He finds a pair on craigslist. He goes and buys the pair. After the purchase he realizes that the shoes are grey market. He now wonders if he is entitled to compensation.

If you could please provide sources that would be amazing. Thank you.

Answer:

I don’t understand why he should be entitled to compensation.

Although authorized agents or importers, or the retailers of the relevant item, try to prevent grey market vending, the sale itself if valid and in fact legal, so that there is no room for compensation.

Even if the buyer would not have bought the shows had he known that it was a grey market sale, this was not stated at the time of the sale and is therefore not a binding clause.
