Yarzeit in ADAR during a leap year

Question:

When a yarzeit is in Adar during a leap year, is it celebrated in Adar1 or Adar 2?

 

Answer:

Thank you for your question.

If the person was niftar during a leap year then the yahrtzeit is observed in the same date as the person died, whether it is Adar 1 or 2.

If the person died during a regular year, according to the Rema (the Ashkenazi minhag) it is observed (regarding fasting etc.) in the first Adar, and some observe it in both Adars.

However according to the Sefardi minhag, the yahrtzeit is observed in the second Adar. It should be noted that even according to the Sefardi custom, for the first yahrtzeit, Kaddish etc. should be said during the first Adar, even though it will be kept during the second Adar during the next leap year. This is because the first yahrtzeit is the end of 12 months of mourning.

בית יוסף יורה דעה סימן תג “כתוב בתשב”ץ (סי’ תכז) “שיש להתענות ולומר קדיש בכל שנה ביום שמת אביו ובשנה מעוברת בשנה הראשונה יתענה ויאמר קדיש באדר ראשון ובשאר שנים באדר שני. ונראה דטעמו משום דסוף שנה ראשונה הוי לסוף שנים עשר חדש כדאמרינן (עדיות פ”ב מ”י) דמשפט רשעי ישראל בגיהנם שנים עשר חדש ולא אמרו שנה הילכך שנים עשר חדש מנינן ובשאר שנים תלוי בפלוגתא דרבי מאיר ורבי יהודה בפרק קונם יין (נדרים סג.)”. וכן הובא בפני ברוך ס’ ל”ט ס”ק צ”ו, וכ”כ בילקוט יוסף אבילות ס’ מ’ אות כ”ב.
