Dividing One’s Inheritance

Is it possible to divide the yerusha so that the wife (or husband) get 50% and the children divide the rest equally, both girls and boys?

In this specific case the boys and girls are already married and although being helped by the parents are self supported.

Answer:

A yerushah can be divided in this way. The division is done by means of a special document (a tzavaah), whereby half the assets are given to the wife, and the rest divided evenly between siblings.

This should be carried out under a qualified expert, because the halachic means of making the transfers are not simple, especially with regard to assets that might be acquired in the future.

Although it is fine, as noted, to divide the inheritance in this manner, one should nonetheless leave a certain amount (a significant sum, such as five or 10,000 dollars) outside the tzavaah, to which the Torah laws of inheritance will apply.
